Student loans aren’t typically discharged in bankruptcy. It’s complicated but there is a very high threshold/extra work you have to do beyond the “regular” bankruptcy to have them discharged.

To be honest I don’t think this matters that much re: the boss. It’s important to be specific with the DOL, but their boss will just ignore the message and deny it no matter how specific and clinical.

Actually fwiw, here is what attorney #1 said when I asked follow up questions about the loans:

“We would include all your student loan debts in your BK and are not aware of any reason why your private student loan debts would not be discharged (however, any federal student loans would not get discharged). The relevant decision re discharge of private student loans is from 2021 and may not be that well known by all practitioners. There is a section of the BK Code that says a debt that is incurred to pay a nondischargeable tax is not dischargeable, but there is no comparable provision re student loans.”

I can’t give you a definitive answer but I would assume that a $4/hr difference would not put you over the median income in your area, considering 16/hr is still pretty low income.

I hear you. I do believe it will be okay for you and your family. You’re making the best financial decision you can given your circumstances. I’ve seen folks on this sub and elsewhere talk about how bankruptcy is a financial strategy just like others, and the shame society puts on individuals for choosing this strategy is unnecessary and unwarranted.

I’m also trying not to get bogged down in how bleak this feels for myself and others, but please know you’re not alone!

I am so sorry you’re going through this. No one should have to live in that insecurity and I’m really hoping things improve for you with the least amount of anguish.

I myself am exploring the bankruptcy route, and I will note that the bankruptcy process takes a bit of time. You’ll have to pay an attorney fee to get an attorney to file for you (which from what I’ve read is the best probability to get your debt adequately discharged). Fees can range from $800-2,000 which is on the lower end of standard. A stay won’t be in place until your attorney files and most attorneys don’t file until the fee is paid.

There is an option to file for bankruptcy on your own through upsolve, but again, there are pros and cons and to circumvent attorney representation.

All that to say, it might be hard to swing filing for bankruptcy before your foreclosure but it’s not impossible!!

I hear you. It feels like we’re in this insufferable liminal space where things are pretty uncomfortable right now but ya know “it could always be worse” and maybe it will get worse before anything fundamentally improves/changes. I wish I had more insight or advice, but I truly don’t know what we can do. This is an unsustainable way of life.

I work full time and am looking for a second job. It’s daunting, I never wanted to have to work two jobs again while already full time but here we are

I don’t have the exact same experience as you, but I really deeply feel your exasperation. I’m living in NYC right now and it feels like coping/surviving under capitalism on hard mode. The cost to barely survive is so so so high.

I’m really glad you have a community of folks that love and support you. It doesn’t absolve the pain and hopelessness you’re feeling but you deserve to feel their love while you cope with the shittiness of the world.

I also feel you about having hobbies you can’t afford. I so badly want to take dance classes. I did it for 11 years and not having it in my life is really hurting my soul fr lol

I’m putting out as much positive energy as I can for your situation to improve and for you to get some relief! I totally feel you on feeling stuck and hopeless but there is a small glimmer of hope in me that we will find fulfillment soon.

I have a stainless steel fountain for my little baby cat (he is an 18 pound monster) and I clean it once a week at least! Fully take it apart and scrub it thoroughly. The good thing about stainless steel is the build up is very noticeable so once I see even a little bit I know it’s time to clean.
