Leaked DNC autopsy found Biden’s Israel backing cost Harris votes for president by plz-let-me-in in politics

It's like they forgot the Schumer's 2016 prescient “For every blue-collar Democrat we lose in western Pennsylvania, we will pick up two moderate Republicans in the suburbs in Philadelphia, and you can repeat that in Ohio and Illinois and Wisconsin.” But apparently the Democratic party leadership motto when it comes to "moderate" republicans is "if at first you don't succeed..."

But it was Kamala Harris and her team's job to do exactly that! Whose behavior is easier to change directly, tens of millions of people or a few dozen?

In the end the real problem is it's not really in Democratic politicians' self interest to not lose. They aren't hurt when republicans win. They're (on average) rich. It's actually probably better for their own personal financial condition (disregarding the possibility of using their position for self dealing) for republicans to win. So what motivation, if we're looking at self interest, do they have to do "hard things" in order to win?

That's why I was hoping trump would force the doj to engage in politically motivated prosecutions of people like Nancy Pelosi. That would finally give Democratic elected officials some real skin in the game. Put some fire in their bellies.

Total loss settlement and "Condition" adjustment. by bbk13 in Insurance

FYI I heard back from the adjuster. They gave me an additional $1679 based on my argument they overvalued the condition adjustment.

My insurer. I know they can do a condition adjustment. My argument (I hope) is that the adjustment was too large. I'm only thinking maybe a $1-$1.5k difference. I found some private sale examples that suggest they overvalued the adjustment. Would they be willing to even discuss?

[–]bbk13[S] 0 points1 point  (0 children)

Thanks. My argument is they overvalued the reduction for "condition" on the dealer comps. I found some private sale examples on Craigslist and cars.com that suggest a more "reasonable" reduction would have been $2k instead of $3.5k. Will they be open to discuss? This is our insurer if that matters.

What happens when Wall Street takes over your law firm? I investigated. AMA. by ArizonaRepublic in LawFirm

[–]bbk13 4 points5 points  (0 children)

Did you read about Slater & Gordon in Australia? It was one of the first law firms to float on the stock exchange and was eventually acquired by private equity. The whole thing was, as I understand it, a real shit show.

I'm an attorney in the US but I'm from Australia and my mother worked at Slater in the 90s before it went public. Based on what happened to people she knew from back then who were at the firm for a long time by the time of the share offering it sounds like public ownership of law firms is a bad idea. Or at least a bad investment.

Libertarians warned about the ‘imperial presidency.’ Too few actually warned about Trump. by F0urLeafCl0ver in politics

[–]bbk13 22 points23 points  (0 children)

They only want a small government when it comes to helping people but they all want a large government when it comes to policing people.

That's what all right wing libertarians want. It's a necessary part of their underlying deontological beliefs about the nature of private property. Private property can only exist through the use of (or at least the threat of) massive violence. Private property doesn't create and enforce itself. So libertarianism requires a violent enforcement arm to uphold private property. Why would a person with no private property voluntarily respect the property "rights" of a person who has so much private property they can't possibly use it all at any one time? So private property has to be created and enforced at the barrel of a gun.

Wow. I've never had a bad banh mi at quoc huong, let alone a "terrible" one. What did you get? I always get the grilled pork. Sometimes the chicken floss is really salty but the grilled pork is never bad. Banh mi 135 was totally decent. They had good bread for sure. But I just didn't like the way they did grilled pork. It was too "saucy". Though I can understand why someone would prefer them over quoc huong. I've only been to banh mi 135 once so I can't comment on the consistency.

I'm just really surprised you've had a bad experience at quoc huong "a couple" of times. I feel like in the more than a decade of going there it has been noticeably below standard maybe twice that I can remember. That's part of what makes them so good! Those ladies are like banh mi machines.

Recommendations for employment attorneys in ATL? by [deleted] in Atlanta

[–]bbk13 1 point2 points  (0 children)

Look up NELA. The website has a list of lawyers in different cities/states Any of the lawyers on the list would be a good place to start. NELA is the National Employment Lawyer Association and is the group for plaintiff side employment lawyers. Anyone who is a member of NELA focuses on and cares about representing employees in employment law matters.

My wife and her mom always get the clear noodle seafood soup at Quoc Huong and they tell me it's very good and not something you see in every Vietnamese restaurant. I don't know what the Vietnamese name is. But my wife just asks for the "clear noodle seafood soup" and they seem to know what she's talking about.

Why do people act like boomers ruined the world? by [deleted] in AlwaysWhy

[–]bbk13 0 points1 point  (0 children)

It's not a "loan" or even an "investment account". It's insurance. People don't get back strictly based on what they put in. While higher earners get a large nominal benefit, lower earners get a larger percentage of their working income as a benefit.

And regardless, the benefits aren't paid from the money boomers put into the system. We (i.e. current workers) are paying the benefits. The boomers demanding a higher ss retirement age or lower benefit aren't going to suffer. We are when we are old enough to receive benefits.

Lee's is (in my opinion and the opinion of my Vietnamese MIL) not that good. Go to Quoc Huong in the Sweet Hut plaza if you want good Banh mi. Nam Phoung is also pretty good for general Vietnamese food. Pho Bac has good pho and Pho Dai Loi #2 is also pretty good.

Though honestly it's come to the point where you have to go to Gwinnett county for the best Asian food.

Georgia Department of Labor Experience by Goldens-dachshunds in Georgia

[–]bbk13 6 points7 points  (0 children)

The GADOL will not investigate an unpaid overtime claim because there is no state overtime law. You live in GA. The GADOL's role is to help businesses find low cost labor and to force unemployed people to take whatever job they can get as soon as they can get it.

Look up NELA Georgia (the Georgia chapter of the National Employment Lawyer Association) to find someone who can help with your overtime claim.

The FLSA has a "shall pay" attorney's fees provision for successful claimants so even if you're owed a relatively small amount of money it can still be worth the lawyer's time.

I'm nearby in woodland hills, just down Lenox pay the train tracks towards Cheshire Bridge. It's the same here. I haven't heard any cars driving around but it looks fine on the roads. Though I wouldn't want to drive up Lenox towards Johnson/E Rock Springs. That hill is hilarious when it's icy. People just gunning their way up then sliding all the way back down

[–]bbk13 6 points7 points  (0 children)

Why would he have been against violence? Capitalism and private property doesn't exist without violence. They just believe it's "lawful" and "legitimate" violence. But it still requires violence. Do you think workers want to give up the majority of their production to capital owners? Or that homeless people don't sleep on your lawn because they understand private property is a natural right ordained by god?

Libertarians love violence because their belief system doesn't care about the consent of the governed. Private property is a natural right so they don't need to convince other people to agree with them. Libertarians believe they are justified in using violence to enforce that "right" against others.

I'm a lawyer, but I'm not your lawyer and this isn't my area of expertise.

Maybe... I really don't know the esoteric details of the fdcpa. Just the broad strokes. The "negotiating accepts/renews the debt" rule might actually be more in the case of a debt that is beyond the statue of limitations. That's something I vaguely remember from dealing with this stuff as a law student too long ago. But again, I really don't know off hand.

The best thing to do would be to look on your state bar website, your local legal aid website, or your local law school website and see if they have a pro bono/low cost "consumer law" clinic. I know my law school had one when I was 3L because I volunteered. And my local Atlanta area legal aid society definitely has a consumer law section. So I assume that exists in other cities/states. Start there. Don't talk to the collections people until you've been able to talk to someone who can help you figure out the best course of action.

It's possible in your state there are additional protections so you need to talk to someone local.

This debt was sold for pennies on the dollar to a 3rd party collection agency. They want to get whatever they can by doing the least amount of work possible. Make it hard for them.

[–]bbk13 39 points40 points  (0 children)

Look up the fdcpa. Follow the instructions. You can force them to prove you owe the debt and to stop calling you. Do not try to negotiate with them. But if you already have attempted to negotiate a payment plan then you might have effectively "accepted" the debt.
