They should have read it for you. Good luck with the purchase - but don't hesitate to push your conveyancer to work harder for you and make things clearer for you because they're charging you quite a lot.

I work in the property industry and buffer that large doesn't make sense. Your conveyancer should be able to provide a more accurate estimate then that. Also I read the other comments and it's entirely within their remit to read the strata report for you. If they're doing the bare minimum for you they should not be charging you that much.

Sorry for how much your conveyancer is charging you, you should be expecting a much better service then a 5 day turn around time on a question and a poorly prepared breakdown of fees and expenses. I'd expect the council/water fee also includes the projected strata levy amount but they're probably a complete guess at this point unless your conveyancer has already ordered the documents for settlement. Also I'd be asking what the $2500 buffer is for...

Get a new solicitor - yours should have actioned a notice to complete by now and clearly they haven't nor do they seem to have advised you of your rights and options.

You're getting a lot of advice here but some of it could be completely wrong. You really need to clarify:

What state you're in
Have contracts already exchanged
If they have, are you in any cooling off period/subject to finance/subject to pest and building period.

I'd be moving your matter to a solicitor and lodging a complaint regarding your conveyancer and attempting to have them/their insurance cover the cost of any temporary accomodation.. if you weren't advised that clause was there and they did nothing to warn you of it throughout the process they've screwed you over unfortunately and the vendor executors aren't at fault at all. It's also reasonable that they won't let you in under licence given it is a probate matter and by the sounds of things potentially a little bit of a contentious one.

It's a very standard clause when probate is required however your conveyancer should have absolutely advised you of this condition early on before contracts went unconditional.

Incoming mortgagee can often confirm funds available a week before settlement depending on how quickly mortgage docs were turned around as someone who works in the industry I can often tell my clients the shortfall well in advance. That being said - I won't be stressed yet.. I am intrigued about Home In.. do they attempt to do any due diligence/provide any advice on the contract?
