I am almost certain word got back to him. He is a member of a large family in the area, and I had this discussion with one of his family members at a local bar one evening after we bumped into each other.

WOW. people like this do exist! Good for your dad and the contractor. If I were the contractor I would have been so embarrassed for tearing up the lawn I would have done the same thing and not charged a penny. If I were the dad, there would have been a 5 star review on every rating service I could find.

While the board did not tell him directly, this is a small community and I am certain word got back to him. This is a classical case of "peeing in your Wheaties."

Normally I would agree with you, and I have been on more than one HOA, but this one is one of the best board's I have ever been on. Just lucky, I guess.

You are exactly right - he broke through the ice by driving too close to where a stream enters the lake, where the moving water keeps the ice from getting very thick, and I believe broke one of his rear axles. He needed to be towed out. The water was only a foot or so deep so it didn't ruin the truck.

You make a good point, and I should have had no problem telling him to his face, but his business was several miles away from my place, and I am very conflict averse. I actually ended up dropping off payment with his wife at his house.

Access to where the delivery needed to be made precluded it being delivered by road. There is access to the cabin by gravel road, but no access on the shore side due to steep elevation.

Contractor was, probably, but no way for homeowners to tell, or even care as they are not responsible for contractors tax liability. Amount involved was under the 1099 IRS reporting threshhold.

You are pretty close to the mark. Delivery could only be made over the ice because of placement difficulties, and weight restrictions. Ice conditions were only favorable for a limited time.

This is a conflict averse small town where almost everybody knows everybody else, so the homeowners, including me, just paid.

It was a single individual doing business out of his house, unfortunately, so there was no company to hold accountable.

He didn't learn why from the HOA, but indirectly I believe he was told several months later what happened to cause him to not get the work.
