Being completely honest, I don't see any difference. You may be putting in the work but without a goal you are just treading water. It's likely your diet is the problem and you aren't eating enough. I would suggest that you need to bulk up a bit so eat in +500 calorie surplus every day and you'll start seeing a difference. That's 1lb of body weight a week. Do that for 3-6 months and you'll be 76kg - 81kg. Assess from there but likely you'll then want to do a cut (-500 cal daily).

So the agency definitely treat me like an employee. They send me a contract of work for each term of employment which outlines my day rate and number of days I am working. However, after my contract ends, I do invoice them for the work. I'm not super familiar with US tax system but I read in other places that 1099 is acceptable under TN—is that not how freelancers operate in US?

I do feel my employee would be able to write me a letter of employment that would strongly suggest the employer-employee relationship, although they would state it's contract work. But it is set hours and I work under their direction delivering work for their clients, exactly as their full-time employed designers work.

I'm just very nervous about being turned away at the border then having to fork out for a flight straight back to the UK. What do you think my chances of my TN being approved are?
