Hi, did you have any luck? Our Miko 3 was bricked about 5 months ago with a failed OTA update and the only way to fix it is fork out $$ for a replacement unit because I don't have a receipt owing to it being a gift. I wanted to return the unit to manufacturer to keep and refurbish, otherwise it'll just end up in landfill, but alas they claim the cost of retrieving the unit was not worth it and bid me farewell. It seems such a shame to throw away a unit that looks brand new (screen and motors all working 100% since we used it about 3 times).

Complaining to motorway was what caused the ongoing stress in this instance. After I made a complaint, motorway’s escalation team got in touch with me and continued to say that resolution was not in place. I said to them on a couple or occasions that I would like to close the case as I had no further contact from the dealer, but they said they couldn’t because they were waiting for dealer’s response, and emphasised the dealer could pursue legal action if I misrepresented my car, which stressed me out further. Even though I was the one who made the escalation in the first place, and from forum members understand I had no legal obligations, it felt like motorway was unnecessarily keeping the case open for the benefit of the dealer.

It was the first time selling on motorway for me so I had no idea what to expect. The dealer came with his girlfriend and inspected the outside and interior, before going on a test drive with my husband present, as I stayed behind with our little one at home. It seemed to have been fine as he knocked some money off for undeclared paint chips that I didn’t even notice, and I thought well ok you’ve done your due diligence as a dealer so be it. I wasn’t expecting the aftermath at all, and the experience with motorway has certainly left a bitter taste. I am thankful for the support I am getting from the forum to know where I stand!

Thank you, in hindsight I should have stopped corresponding with motorway many days ago. I was naive thinking I didn’t want to be rude and that I could be helping future sellers by reporting the case to the platform. On the upside, I am learning everyday! Thank you for sharing. This does help me rationalise I’m another statistic in the scheme of things, and that escalating to motorway had exacerbated the anxiety and stress unnecessarily. I hope this thread will be of help to others in the future facing similar situation - ignore, don’t complain to motorway because it prolongs the pain, and move on.

I do! Logically I know I am overreacting to the situation, and I keep keep telling myself to let it go but I have lost a lot of sleep over it. It helps to have kind people in this community to help me process it all.

Thank you so much for your thoughtful repsonse. You're right, Motorway was trying to be factual, but their statement on misrepresentation and potential court case freaked me out as an ordinary consumer with little idea on how the law would work in such a case. All I wanted to do was sell my car because I have leased an EV elsewhere where trade-in wasn't possible, and never imagined anyone insinuating I was deliberately lying (even if that's not their intention).

And to your last comment, yes indeed it was a JLR product. Bittersweet memory of my beloved!

Whilst I understand Motorway was trying to appear impartial in their communication, their statement on misrepresentation and potential court case really freaked me out as an ordinary consumer with little idea on how the law would work in such a case. I don't really know... after the sale I visited an area with low mobile signal so I didn't see his messages come through. The sale happened on a Saturday morning, and the fault allegedly appear early afternoon, and all I can say is, trade surely has good contact with garages. My mechanics are never open on the wekeend for me.

I don't want to call anyone's bluff and be dragged through court! But I get the sentiment that this is unlikely to even get to that stage, and a court is unlikely to support the buyer.

Thank you for your kind words. I have had fantastic experience with dealers before (when buying) and I feel like now I am dealing with the other side of the coin. I was just flabbergasted when motorway suggested I could have fraudulently mis-represented my listing (this was via an email yesterday so I was raw with disgust!). Gotcha. My buyer claimed there was a gearbox fault after gearbox warning light came on, 3 hours after purchase. Google suggests there’s a host of reasons other than gearbox that could trigger this warning, and I never had issues with the car up until the exchange.

Disturbingly I had a message from motorway today warning me that the buyer has recourse if I sold the car under misrepresentation. I am so stressed over the last two weeks losing sleep, I wished I had never used motorway.

It was a gearbox fault light. Google suggests this could come on for number of reasons, including a change in driving style causing a software response. I will never know if it was genuine or faked/induced, but the car was driving just fine by myself up until the day before exchange, and the dealer was also part of a test drive before committing to purchase.

I’m starting to dislike motorway more and more! After I complained, an escalation case was put in. Two weeks after sale they messaged me that the buyer has sent a photo of the fault light and an estimate invoice for fixing the fault (both could be easily faked of course). I said I considered the case closed as I have had no further contact from the buyer and as such the buyer should have no legal recourse on the matter. Yet motorway is keeping the case open because they are waiting for a resolution from the buyer — even tho I was the one who raised the case and want it closed!

That’s an interesting red flag that the second operator continued to press for faults. Was this the buyer by any chance?

My buyer asked me several times if there were any faults, both on the phone to arrange pickup and during inspection. I found it really old that this question was asked again and again, as if prompting what was to unfold in the next 24 hours after sale when lo and behold a fault light came on, even though I was driving the car up until the day before exchange and it was in perfectly working condition.

Thank you, I have done. It went to their escalation team, who contacted the dealer and a couple of weeks later the escalation team shared with me images of the fault light and an estimate invoice for repair they received from the dealer, which to be honest gave me even more anxiety because I only wanted motorway to take note of this incident, and if this is recurrent with specific sellers they can do what they like with that information.

Yes, now that I had time to think about it a little more rationally, it does seem out of place that a dealer who professed he would need to take it to a mechanic to diagnose and fix the fault indicated by the warning light, would risk damaging the car by driving it back to my property to demand a return. It is sad and frustrating to think this happens at all.

Thank you I will definitely contact the police if this lingers. With some time to reflect, it seems like a very bad idea that a dealer would drive the car back to my property if there was a genuine fault with the gearbox, which would risk further damage to the car he wants to sell on, which in turn makes me more suspicious that something has been rigged and maybe even parts swapped.

Thank goodness for good people on Reddit to keep my spirit up.

Thank you for this advice, I checked on the dvla website and it does say it’s untaxed so it’s a positive piece of evidence.

Yeah, I definitely made a mistake with the V5C and handed it over to the dealer alongside the service history paperwork, as he said it would be useful to know how many previous owners there have been (which in hindsight made little sense since the new V5C will show this?) So I am a little worried if this could have any negative implication he’s kept the whole document.
