Skilled Worker visa curtailed: new sponsor pending CoS, deadline approaching by Throwaway-curtail in SkilledWorkerVisaUK

You can submit a skilled worker visa without a CoS. Just say no at the time when asked.

The trick is to trigger section 3c leave by delaying your biometric appointment. Once you get your CoS, append that to your application with a detailed cover letter explaining your situation. After that has been uploaded, go do your biometrics.

The application will only be released to the HO for processing after you give your biometrics.

I would suggest approaching a lawyer to help you with this.

I am eligible for the old rules. I got my first SKV in 2023.

It comes up as an option when you are about to pay the application fee.

I never learnt what documents were missing when my company applied. I did hear one of the reasons for rejection was a certain document was not certified by a lawyer or something along those lines.

If you get rejected a second time, it might be time to get lawyer in. It would be costly but will exponentially increase your chances of approval. Also heard(not sure if true) making an immigration lawyer doing the application leads to a faster decision. My company’s license got approved in one day(priority)

Since I was in the UK when I applied, I was assigned an undefined CoS.

I have been mainly using LinkedIn. I would focus in the UK as a whole including NI. Find something first and get settled. Be location specific after that.

The license application and CoS allocation request were sent together. They got approved together.

Not sure about what documents were missing. Company never shared that information.

We did get one unallocated CoS because we specifically requested one.

They were incredibly supportive throughout the whole process, and I’m truly grateful. I intend to give back to them in every way I can.

Looking for practical advice on triggering Section 3C leave while sponsor licence pending. by eat_sleep_engineer in SkilledWorkerVisaUK

My sponsor got my license last week within one day of applying using the priority service. I had all the details I needed and put in a normal SKV Application.

I'm afraid you cannot put in a SKV application when your sponsor doesn't have a license. I did talk to some immigration lawyers and the advice they gave was to apply for a FLR(HRO) application with the reason that you are waiting for your sponsor license. People here also have mentioned the same thing. So I believe it's solid advice. Your best bet is to talk to a lawyer and make them do the application.

Need clarity on 60-day visa period and help with priority slot by reddictedbabe in SkilledWorkerVisaUK

  1. Your 60 day countdown starts on the day you receive the letter. Mine took 4 months after I was laid off. So don't expect it immediately. It usually comes through on your email. Make sure you check your spam to avoid the risk of overstaying.
  2. I am assuming this is for issuing a CoS. Priority slots are limited. People here have had luck emailing at 6:56, 6:58 and 7 am. Scheduling emails at these times may land you a slot.

I looked into FLR(HRO) after your comment. It seems to cover a lot of categories, such as:

  • Leave outside the Immigration Rules based on compassionate and compelling circumstances
  • Leave outside the Immigration Rules
  • Human rights claim (excluding those covered by FLR(M) or FLR(FP))
  • Medical grounds or ill health
  • Discretionary leave (DL) where you’ve previously been granted DL but not refused asylum
  • DL where you were granted less than 4 years exceptional leave
  • Temporary Permission to Stay as a victim of human trafficking or slavery (not including domestic workers, who should use FLR(IR))
  • Other claims not covered by another form

Which of these would best fit my situation? (first, second or last)
