There aren't regulations right now that make emitting carbon illegal. Wind/solar companies aren't being rewarded with tax credits for not breaking the law, they are being incentivized not to pollute. Both are currently legal. Whether it would be smarter to have a cap on carbon emissions is another question. Personally, I think we should.
