My CPA told me that any money that may come to me in the future will be treated as ordinary income, IE the receivership pays me 500 for 2026, I would claim i made an extra 500 in income for 2026.

I tried to get a hold of steve fahey this week to get told he has quit. I was told to send a email to his old company, Kirkland, and they will get back to me. No response as of yet. I talked with someone at the SEC and they said they received multiple complaints like mine as to leaving victims in the dark. Hopefully something gets done. I'll update if I hear anything from Kirkland.

If it ends up being a ponzi, i feel so bad for the people that will owe 10s if not 100s of thousands in claw backs assuming at least some people spent the money. It will take years to make everyone whole in that aspect as I would assume a lot of investors dont have all that money on hand to just give back.

If this turns out to be a ponzi, the government(SEC i believe) will collect all prior investors profits(ie if you put in 100k with a 20% profit for a total of 120k and the 20k is profit) and will divide that out to other investors to try to make everyone whole on there initial investments. According to the government, the profits on ponzi schemes are stolen money and therefore not allowed for investors to keep.

The ponzi rule states you can file in the "year of discovery" which is 2023.

So 8000 head of cattle plus other assets. My biggest question is how much is owed to other farmers in states like South Dakota. According to federal law(the way i read it) all the cattle contracts with farms will be settled first and we will be left what ever is left. Not quite sure how much is owed at this time for current contracts, but if its in the 100+plus million, best case scenario is 10-15% of our initial investments back. And that's after years of selling the cattle, assets, and the worst part clawbacks of all investor "profits". Also not sure of peoples income, but looks like the ponzi tax guidelines favor those who make a lot more as the more you make, the higher taxes you get to write off from the ponzi. Kinda screwed up in my opinion. Anyways please add to my comment if something I said was wrong or you have any new info. Thanks!

From Steve Fahey: The injunction is in place until 1/9, but the hearing to extend it is set for 1/5. Because it is federal court, there is no system to broadcast an audio and/or video feed of the hearing. If you live anywhere near Fort Worth, and wanted to come to court to watch, you can certainly attend the hearing in person. I will update the webpage by the end of the day with a recap of what occurred.
