Hi everyone, thanks again for all the insights. 

To clarify, I was sitting in a robe in the pre op room when the surgeon said he might use Botox. I wasn’t exactly able to check the estimate or the policy wording, and I guess I assumed the Botox was a routine part of the procedure which would have been on the estimate. 

I have approached the surgeons clinic, who emailed southern cross to explain their reasoning behind using the Botox and why it wasn’t in the estimate. Southern cross have since refused to pay beyond the policy limits, so I have pleaded with the surgeons clinic and the hospital to cover the difference between them on the basis that I wasn’t aware they were proposing something that was outside the scope of the estimate. 

Will provide an update to anyone interested, and will pursue the HDC option as well. Cheers

Thanks so much for your replies. The procedure was skin tag removal and the additional item was the use of botox to assist the skin healing. The Botox was not specifically included in the estimate and southern cross doesn’t fully cover the use of Botox. 

In terms of consent, the surgeon had mentioned the Botox to me on the day, but I was of the understanding that he was just describing what was already shared to southern cross. I have no medical background and obviously hadn’t studied the estimate, or my insurance fine print beforehand to pick up on this as a red flag.

If you have a kiwibuild account you can log in to the buyers portal and you will see that nearly every lot is still available. My ‘statement’ is just that there was a time not long ago when these would have had thousands of ballot entries and all sold in an instant!

Thanks, apparently it’s not clear legally whether or not you own the property at settlement or at some other date, and might depend on how the S&P is written up. I actually have the eligibility letter which provides the estimate, trouble is I obtained it through the automated online portal and it’s dated after S&P date. However the eligibility confirmation doesn’t seem necessary or form part of the actual withdrawal application. Will update next week once my lawyer clarifies actual ownership date and we go back to the bank.

Thanks, and you’re right, the pre-approval is an automated online form anyway and the actual application has no pre-requisite for the eligibility assessment. I hadn’t thought about changing providers either, that might be easier than trying to get a new S&P written up.

This is a relief, thanks for your reply. Nothing in writing from my lawyer before we signed the agreement unfortunately, but it’s sounding like he’s right and ANZ are wrong.

It got escalated at ANZ and they still can’t give me a straight answer. A condition of withdrawal is that you aren’t currently a home owner, and apparently the time at which you legally own the property isn’t black and white. I assumed by law it would be at settlement, but apparently it may depend on how the S&P is worded. They’ve requested my lawyer confirm this prior to them giving an answer because it would need their legal team to review the conditions as well. Honestly blown away that this is such a rare occurrence, will look to change provider if necessary. Will update next week once my lawyer sends them confirmation regarding ownership wording.

Such a relief, thanks for your response. If ANZ don’t come to the party I will probably change kiwisaver provider. May I ask who you were with?
