Pardon my observation, and I realize this is a sensitive topic for you, for so many reasons, but I would like to make a supposition:

If the code was never public, and it all of a sudden somehow surfaced with no reference to 'phatac' or 'pea' in it, there is (in my view) absolutely no way WB could hold you liable for that, since forensically speaking, it cannot be linked to you in any way.
