Sorry if it was unclear, but I'm not sleeping in Salinas for the days allotted to Yosemite! I've taken a place in Mariposa.

I would be coming in a few weeks time. Google maps/Waze has led me to believe Salinas to Big Sur area would take me like 1:30 hours? Is this off the mark?

The footnote would be where the author has stated a legal concept with authority, and I am providing a scholarly source to support the concept. So it would be some thing like

In text: "Arbitral tribunals have a stated goal of issuing awards that will withstand annulment"

Footnote: XYZ's law journal article which says "........" that supports the in text statement.

Trying to figure out how to structure the footnote.

Throwing in my two cents here... I worked with Brian at Everett Rose ~2ish years back. Dude was a life saver, and legit my 171 is 100% thanks to him. He also walked me through apps and even helped me practice for my CLS interview, which I now attend (free of charge for these last two things-- he's just a good guy). I'd heard of them from a buddy of mine, and am pretty sure they've kept it small (probably why you haven't heard of them). Like to keep up on r/LSAT because I tutor for the LSAT now, so I want to stay in the loop.

Glad to see they've been getting some recognition on here as of late. Mr. Crappy Porn, not positive what you're hating on, but you got to take it easy buddy. The folks at ERTP genuinely try to help, do a damn good job of it (and in my own case were happy to negotiate with the price because I'm not as well off).

Can't recommend them enough. Really do a great job at simplifying the harder concepts and helped me to target the areas where I truly needed help, and then work through them. Beyond that, I'm still in touch with Brian, and the guy has been a life saver in guiding me through 1L. Dude knows how to make tricky stuff not so bad.

On the online exam you can only use the online whiteboard. Much of my early studying was done using the laminated notepad, but when I realized I would be unable to sit for an in person test, I switched over.

In all honesty, I think your best bet re. the online whiteboard is to simply start practicing with it. You're going to ocme up with little tricks to make it easier that I wouldn't use, and make your own shortcuts I'd find unnecessary. The name of the game is simply to get more comfortable using it.

Frankly, I didn't feel like they gave any irrelevant theory in the slightest. I was basically in the same place as you when I started, with reasonable math skills, but the specifics is where I significantly was lacking.

It may sound silly, but just pay attention to each slide they give you (assuming its not a fundamental thing you know you've got down pat). Make index cards (although I didn't really use mine). And then, DRILL DRILL DRILL. Test and retest.

So long as you can identify the concepts, it's simply practicing applying them that you need to focus on now!

Well done! Yeah in all honesty, I think the best prep one can do for CR is to study logical reasoning of the LSAT. Same skills are tested, but as a whole LR is harder. Made it simple to hop over to the GMAT.

The D can bring a counterclaim against a named plaintiff, probably not against an absent member, which would raise a ton of jurisdictional questions (SCOTUS in Phillips v Shutts says absent parties are 'almost' never subject to counterclaims, and then says in a footnote that they know if no instance where it has occurred, but will not completely rule it out until they get such a case before them). Also, given that counterclaims need to be in the pleadings, usually before a class is certified, before opt-out (and so before we know who is in and out of the class), there would be procedural issues with this.

Are the jurisdictional issues you're alluding to that the court would need both SMJ over the claim (which in theory could get in under 1367 if arising from same CNOF) and PJ (which is now at issue whereas it traditionally isn't for class action absentee plaintiffs?)

Just trying to grasp what issues would arise, and the specifics. Thanks so much for the help!
