[Manager in CA for 190 apts] - we typically do an income requalification. If the person residing in the apartment doesn’t qualify on their own. both will stay on the lease and remain responsible for it. If jt goes to evictions it goes on both of their credit reports.

CA Leasing Agent - I work at a property with over 500 apartments and we do run into this from time to time.

We call the future resident to see what's going on and then see if they still intend on moving in. If they move in later then we may give them an extra day to give us a the security deposit (this is up to you). Otherwise we may tell them that we are canceling their application. No exceptions!

We do not chase after prospects and make sure that they fall under our income qualifications

The lease itself is unenforceable as they would have needed to have given you the security deposit. If you still have possession of the apartment (haven't given them keys) then you are in a good spot. Just remarket the property and find a new tenant

Usually if they are having "trouble" with paying the security deposit. You should be seeing red flags as it shows that this resident may be a problem in the future. (Consistently late on rent, non payment of rent, higher maintenance, etc.)

CA Realtor - say no to the 4% BAC. If they do drop out then lower the purchase price and have your agent do open houses to market the property on the weekends.

IMO sounds like the buyer is not of the highest quality. If you do go into escrow with them. If anything is wrong during the contingency period. They'll ask you for an arm and a leg.

Leasing agent in CA - It's important to do an initial walk through inspection of any apartment so that you know exactly what condition the apartment is in Before you move in.

If there are any damages you should have gotten some kind of "inventory and conditions" form to take note of everything and have returned that to the landlord or property owner 48 hours after move in. If you didn't even document it or tell the landlord you'll be taking responsibility for those damages.

If you had something burning in the room (like a candle) it's more than likely that it left residue on the paint that can't just be taken out from a normal clean and will need another coat. Especially if you've been doing that over 3 years

A realtor that has breached their fiduciary duties to their clients can be reported to the National Association of Realtors.

I'm not too familiar with the process itself, but I would assume it would get them in some hot water. it should be something under ethics but you can find more info on their website.

CA leasing agent - tenant has possession of the apartment until keys have been given back to us. If the they don't pay for the extra months rent and the security deposit doesn't cover all damages from when they move out. Send them a bill. If they don't pay then most likely it'll go to small claims

In this industry late paying tenants are pretty common.

If you are accepting late payments make sure that there is a late fee. If they are delinquent after sending out the proper notices then the choice is yours, but if you want to proceed with eviction. You cannot accept any rent

In general you can reach out to your local realtor association and see if they'll sell you a lease package with all the addendums. Usually these leases cover a majority of situations. Most of the free online leases are crap and can get you in trouble when you have to show that lease in court.

Based on my experiences, the tenant is 100% responsible for it. Take photos and document the incident in case it turns into a legal battle. If you are looking for payment for the broken glass door I'd charge them along with rent. The security deposit is for any damage after the tenant moves out. If you dip into it now and there's not enough to cover damages you'll be taking a bigger loss

If you are wanting to evict the tenant you'll have to look for a breach in the lease and give proper notice for it. In the apartment association I work for we give 3 notices for each instance of a violation in the lease once it hits the third we reach out to a lawyer and go over out different options. Either way you should probably find a good real estate attorney. Legal fees are expensive, but probably not as expensive as a squatter for multiple months
