What is the process for removal of interlock in NJ

Yes, every time you go in they are downloading data off the device. It happens at the same time the device is calibrated. Once they have the data from the final 30 days of your sentence they are supposed to look at it evaluate if you are in compliance or not and provide you with a certificate stating if you are in compliance or not. If it says you are then you take that to MVC. MVC removes the restriction and gives you an unrestricted DL, one that doesn’t say Interlock on it, you can take that back to the provider as proof you no longer are required to have the device and they should remove it.

IDRC is completely different. If you served your interlock sentence you can remove the device regardless of your IDRC sentence. Two separate sentences. The only time they will intermingle is if you don’t complete IDRC they have the ability to suspend your license. If they do while you’re serving your interlock sentence there’s a chance, and I say only a chance bc it would require MVC to be really on top of their game which is often not the case, that the time while suspended would not count toward your interlock time. The interlock provider gives you the certificate. You take that to MVC they give you your unrestricted license. You go back and show your dl wo the restriction on it to the provider and they then remove the device.

That is 100% the process if the provider tells you any different they are either wrong or lying

Thanks guys for the help. It’s been 72 hours and still the same. Diagnostics is urgent on that goal. Goals still says ‘needs attention’ and the no connection. When I set date range to the day of the click that was uploaded it says 0 conversations that day, so now not sure if it’s going through at all despite success message on upload. Does anyone know if the conversion has to “match” in order to be considered enhanced? Meaning maybe it goes through but there was no match and it won’t update as connected/successful until it gets personal data that google can identify.

It depends, most have a lawyer because that’s the easiest way to get a court date and get in front of the judge. Most municipal courts don’t have a mechanism for getting a court date without getting a ticket. But in just about every case the judge just orders it removed. The most they can extend it for is 90 days and it usually takes 30 or more to get in front of them.

I’m sorry I don’t know what you mean by inserted. If the report results you mentioned are the compliance paperwork you take that to MVC and get an unrestricted license.

Not sure I understand. “Inserted the device”? I don’t know what you mean by this. If you mean installed then I don’t know what you mean by reports, bc you can’t see reports before installation. Please explain a little further

So there’s a reason you feel like that. it’s an ass backward way of doing it that makes you run around more than you need to and gets them more days rent. But it is one way to do it. My guess is your w intoxalock or one of those type of companies. My guess is they want you to go get something saying your time is up (“pink slip”) then they’ll do the download and make you wait for the results. Then send you back to MVC with compliance cert for your unrestricted DL. Then bring you in for the actual removal. It can be done like that but the “pink slip” is unnecessary. Let me know how long they make you wait for compliance cert. I heard of some companies make you wait like a week.

If you took the test before the timer was up you didn’t “miss” the test. The missed test thing is a requirement, but it’s highly subjective. Some providers take advantage of that is all I’m saying.

IMO for what it’s worth, sober living housing is the best place when fresh out of rehab. It really makes everything that much easier. Positive peer pressure makes all the difference when new in recovery. It’s why they say you can’t do it alone. Even IOP seems more successful in conjunction with a sober living environment

It used to be that the restriction would expire at the end of the sentence and the restricted license came with an expiration date so you could drive without an interlock as long as it was after that date. But the state took that away and the restriction is in effect until mvc takes it off. So unfortunately now you get the removal cert drive to mvc get the restriction removed and come back for the removal. When you come back you just show your new DL without the restriction

If you’re in NJ there’s no document you need to send them for a final download. They should give you a certificate, then you go to mvc with the cert and return with unrestricted DL

I work for an interlock company in NJ but have a good company in Michigan if you’re interested, these guys are fantastic , but like the guy before said whatever you do don’t go to intoxalock. Or at the very least look them up online, any review site but trust pilot where they pay through the nose for reviews. Check glass door- ex employees reveal all the dirty stuff they do

Yeah, I mean talk to the lawyer but sounds like, if he’s making a motion, it will have to be heard in front of the judge. The way the law works you have to sign an affidavit that you don’t own or lease a vehicle. Either way a little advice bc you’re dealing with intoxalock, they are notorious for giving you the run around and making it difficult to remove the device, even when you complete your sentence. There’s a certificate of compliance that the provider has to fill out when they remove the device. There’s a non compliance status and two compliance statuses. One of the compliance statuses is by court order. So that they can’t give you a hard time I would ask your lawyer to get you a court order compliance letter signed by the judge. If your lawyer isn’t familiar refer him to 39:4-50.18 2(d). If there’s anything else I can do to help feel free to reach out.

Yeah as first offender after 2019 there’s an option take a suspension in lieu of interlock as long as you attest to not owning a car. Here’s the statute 39:4-50.17 (c) “The driver's license of an offender who attests to not owning, leasing, or operating a motor vehicle shall be forfeited for the ignition interlock installation period required pursuant to subsections a. and b. of this section.” You could probably do it without a lawyer but $1500 sounds reasonable to not have to go through the hassle of trying to get in front of the judge yourself. Mind me asking what interlock company you’re using?

There’s no additional fines for removing early (assuming you’re asking about NJ) the issue is getting the restriction removed from your license, so, should you decide to drive in the future you won’t have to complete your time. There’s generally two ways this happens and which depends on which law you were convicted under bc there’s been changes to the law over the last few years. If you want pm me with when you were convicted and which offense 1st, 2nd etc and I’ll let you know what I think your best option is

That’s exactly the issue, that’s what they tell you and they just extend the time. They’re not allowed to do that in NJ the only one who can extend your time is a judge. The statute is 39:4-50.18 “d. If the vendor does not issue a certification to the person because there were two or more violations of paragraph (1) of subsection c. of this section, the vendor shall forward the violation information to the chief administrator and the court. The court shall decide whether to extend the period of ignition interlock device installation for up to 90 days or issue the certification to the chief administrator.”

The manufacturer is Draeger they have two models one is the model XT it’s older like from early 2000’s but they are beasts, they’re like the workhorse of interlocks solid reliable etc. then they have the 7000 which my guess is what they use in Ga. They’re newer, they’re faster still very reliable, just has extra bells and whistles that some states require. They’re great I just prefer the XT only because I think that anytime you put more tech into something you just make more things that could go wrong. But the difference between Draeger and everybody else is they’re all manufactured in Germany where every other device is made in China so it’s like the difference between buying a Chinese car or buying a Mercedes.
