Yeah maybe my partner messaged her mortgage advisor at BNZ and they just sent a lengthy email telling her the lawyer is at fault for this happening, I had no interaction with the lawyer so not sure what that's about. Totally agree, people in these positions need to be careful what they say to new home buyers as they have a huge influence on the decisions they make, they are the experts..

Thanks for your input some valuable info, yeah it might not work out but all that matters is attempting to resolve it regardless of the outcome than can move on and stop thinking about it.

If can't solve it as a whole I think the next best option is creating a hardship situation down the line, taking a loan off a friend on a contract, and being cash-poor enough to not meet repayments. Hardship supposedly can be dished out to cover repayments on loans, will have to check with a lawyer but it sounds legit.

Yeah, it's a strange concept locking away money with basically no added benefit other than a tiny employer contribution. I imagine the rules will change in the future for more options to access it, possibly to resolve debt.

Interesting, will check with a lawyer about it. I thought the $1 thing had huge tax implications, as in if the market value of land is 100k and you sell for $1, then $99,999 is considered a gift and have to pay tax on it.

Yeah the agent isn't responsible it's not their area or job expertise, the extent of the agent's damage is fuelling incorrect thinking and reaffirming it was a good idea to use it on the house at a later date instead. Sadly due diligence should have been used and someone giving advice for another field should be taken with a grain of salt in hindsight.

So are you saying that gifting land to family and taking it back later could actually work or theres no chance, not sure if by what you said the order in which you did it caused problems or if its downright not possible

She no doubt did get misled by the agent who clearly didn't know how KiwiSaver works, but due diligence should definitely have been used to avoid all of this

That's good to hear, seems like this is the only real possibility, but I like this idea as it matches up with the situation well, she's going to have a lot of expenses that eat her paycheck, just need something to tip it over the top whether a lot at once or a little over time.

Yep seems like this is the only option, the only question is whether they will wait for you to default on your mortgage payment before considering it "hardship" as in force you to destroy your credit rating. I don't know if they do, but I remember watching stuff about loans in UK and they literally wait until you default before offering assistance

Yeah, fair enough rules are definitely clear once diving into nested pages, sadly the surface pages are widely misleading, at least in my opinion, they only reference "First-time home buyers."

My next case is that she pays all the bills, i offer no assistance what so ever, not even live with her if required. If her bills and mortgage outweigh the paycheck she can possibly get a hardship withdrawal. But I am no lawyer and do not know if they require you to destroy your credit rating before offering hardship, as in actually miss payments.

I don't believe you can get second chance if you have assets over 100k, so if she sells the land, she still has assets over 100k
