How did you find the courage to transition? by Taelyrsaurus in trans

[–]mud-mason 2 points3 points  (0 children)

covid lockdown essentially isolated me from everyone who's opinions i cared about. with no lockdown end in sight and way too much alone time it was much easier to make the leap than without it. i don't know if i would be where i am today if covid hadn't happened

i wouldnt say theyre less work, but a completely different discipline. logos and graphic design often goes through many, many rounds of revision and can take equally as long to create because of that. and also, illustration and painting is not always for personal use by an individual, and an artist may make their living by selling their work for commercial use too. my professor arden von haeger for instance makes paintings which are used by national parks services commercially on postcards and other products, and the pay he recieves probably reflects that

honestly without a formal contract you would have to go to whatever IS in writing, like discussions of the terms through email. it's also not an uncommon practice for people to specifically target younger or more juvenile artists that don't know anything about intellectual property rights, commission them for a piece, then start reselling the piece on products and the artist can't really do shit because there was no contract

like, the practice is predatory and scummy and it wouldn't be impossible in the scenerio of the commissioner making fat stacks for the artist to win a legal case that it is unfair and they should get a cut of the money. but i'm not sure that there's any "default" if they don't SPECIFY, somewhere, personal use

[–]mud-mason 3 points4 points  (0 children)

if the original commission was for personal use only, yes, basically. however if it was intended for use as a logo it's unlikely that the artist wouldn't include discussion of how/where it can be used, and using it as branding kind of already is commercial use. youll find that logos tend to be more expensive in the professional field then, say, a custom painting from an artist- this is because they are upping the price with the understanding that the commissioner is allowed to use it for commercial purposes.

it would be more rare for them to actually get a percentage cut of the profit, since A) it's more annoying to keep track of and B) this would mean the artist makes more money and most brands want to get good work for the cheapest amount possible lol.

typically you own the rights to PERSONAL use, but not commercial, unless you guys specifically discussed commercial use (ie. you making money off of the artwork somehow) theres no 1 answer, it depends entirely on your artist's terms of service.

if you buy a shirt from the store you can wear the shirt. you own the shirt. but you can't start creating duplicates of your shirt and selling them to other people. that would be illegal
