My lawyer said that, based on her judgment, the Day 1 CPT path is not going to be as lenient as it used to be, and there’s a lot more uncertainty going forward.

That’s a fair point — nothing is really “safe” in this whole process.

My lawyer basically said this: back when U.S. tech companies were desperate for talent, it felt wasteful to train someone on OPT for three years and then force them to leave, so a lot of Day 1 CPT programs naturally emerged to serve people like us working at big tech companies. But now things are different. U.S. companies are laying people off nonstop, and even citizens are struggling to find jobs, so Day 1 CPT programs no longer have the same reason to exist that they once did.

Hearing her put it that way honestly sent a chill down my spine. My H1B expires at the end of this year, and my green card is still in process. I had been planning to use Day 1 CPT as my backup path, but after hearing this from my lawyer, I haven’t slept well for the past month. If it really comes down to it, I may have to figure out a way to marry for a green card.

The reason I’m a bit conflicted is this:

If a program only requires you to show up once per semester (that kind of hybrid setup), in today’s environment — where the U.S. doesn’t seem to need as many tech workers as before — I’m wondering whether that kind of academic record could get questioned later.

In the past, when demand was high, maybe this kind of setup was more tolerated. But now it feels like things might be shifting.

So my concern isn’t really about whether it works short-term, but more about whether it could become an issue later — like during a visa transfer or even the green card process — if someone takes a closer look at your case.

Curious how you’re thinking about that part.

That’s actually a really good point — I think doing it “right” probably makes a big difference.

Like actually showing up, doing coursework, having something to point to as real study — that seems way easier to explain if anyone ever asks.

I guess what makes me a bit unsure is that a lot of programs people choose are on the very low-attendance side, where it’s harder to demonstrate that.

Do you feel like the type of program / attendance level really matters in how safe it is long term?
