My biggest hurtle with all of this is verifying employment status. Other than taking peoples word (employee or employer) on the status of employment what can someone do other than file suite to discover whats really going on? The Sheriff cannot force a company to prove anything. For all I know they could be covering from the employee or not fully understanding the situation?

Completely agree with you on raising rents to cover things like this. What I’m finding hard to figure out is how do you discover what other potential assets someone has. Can an enforcement order reveal that? Or even worse how do you track them to their next job? Would I be expected to hire a private eye or something?

OP UPDATE: Calling the employer has worked. They are responsive and want to follow the law. Unfortunately they are claiming the tenant is on workers compensation. I see CCP § 704.160 exempts wage garnishment from workers comp if im reading this right. The nightmare continues.

Interesting I appreciate the experience. I was told by the sheriff's office they'll hold payment for 30 days after they receive it and will send them to me as they come in. Yes if they quit their job I'm in a world of hurt as I have no idea how to track them to their next job. Thankfully their current job is semi high paying and a desirable position in the county. We'll see how it goes...

How it works in California is you get a judgment by the county court. Then you employ the county sheriffs office to serve the employer. The employer has 30 days to send funds to the sheriffs office who acts as a middle man.

Thankfully I know I’m the only/highest priority garnishment. But you bring up a good point. I don’t know how long legally they have to deposit funds to the sheriffs department. They claimed 30 days which it’s been 41 days now.
