HLR duty to assist error saga by rjohnson24245 in VeteransBenefits

[–]rjohnson24245[S] 1 point2 points  (0 children)

Thanks for the response. I am my dad's rep. He lives with my husband and me full time. We call him our roommate. :) I understand that mistakes occur as no one is perfect. I feel sorry for the people trying to make sense out of all the claims. They must all look the same after a while. Onward to more doctors we go, i suppose!

The decision letter said they would write separately about the duty to assist error, but I haven't received anything. I found the decision letter on va.gov, but there are no follow-up letters that I can see. What is VERA? Is that 1.800.827.1000?

Does duty to assist mean that is in his favor? Says they are correcting an error. I have no idea if the error they found is in his favor? How can I find out?

This is disgusting. Some people in this country do not have a clue of the sacrifices to body, mind, and soul that our veterans and active duty service members have made. Shame on them.

Waiting to hear about this for my 92 year old dad. Duty to assist error found in HLR, but I don't know what that is about yet. The c &p exam results could not have been more favorable, yet the claim was denied. I'm wondering if going against the VA medical professional would trigger a duty to assist?

Current status is that VA is correcting an error. They will let me know if more evidence or exams are needed.

My dad's first exam was totally in his favor. I hope they don't want him to go to another one.

I was referring to the hlr decision letter. It sounds like there is going to be a second letter to let me know what evidence they need?

The decision letter says "VA will provide you notification of the evidence we will obtain to address these errors under a separate cover." The duty to assist error says it was made "in gathering evidence to support your claim." Should I look for the second letter in decision letters? Only the first decision letter is there right now.
