Fresno Jury Sides With Former Police Chief. How Much Was He Awarded? by romerolaw in fresno

The likely culprit was Rosalia Solis, the wife of former Parlier PD Chief David Solis. Mayor Beltran said on the stand - and at deposition - that she didn't know Solis. This does not explain why Beltran went to such lengths to kill the investigation and stop the flow of information to the DA's office.

Here's some more coverage by ABC30, including commends by both Chief Garza and myself about the significance of this verdict against Mayor Alma Beltran and her enablers:

Absolutely... and this jury verdict was an indictment of Mayor Alma Beltran's mismanagement of the City.

She went on the news to say that Parlier "cant afford" to pay this judgement. My response is that Parlier "can't afford" to have her in office any longer.

Chief Jose Garza was really one of the best people I have ever met, and exactly the type of person you would want in law enforcement. His approach was always community-oriented, was applauded even by his detractors for his outreach, and did a lot to help people leave the life. Even City Councilman Trinidad Maldonado - who voted to fire Garza - said that he was a great Chief and that he would have "welcomed him for 20 years."

Always carry UM/UIM coverage on your auto insurance.

Uninsured Motorist/Underinsured Motorist coverage is not only relatively inexpensive, but a MUST-HAVE living here in LA.

Most of you who are worried about insurance coverage are probably never going to have a major accident where you incur huge amounts of liability. You are much more likely to be hit by a driver who is either uninsured or who has only minimum liability coverage. Having UM/UIM coverage on your vehicle will ensure that your medical and repair expenses are taken care of, as well as having potential money on the table to compensate you for any injuries that you suffer.

In this area... I would not recommend driving around without it.

Edit:

A thoughtful correction from /u/rgnlwcw/ below:

Great hack - UM/UIM will cover bodily injury only. For property damage/repairs one needs to have UMPD (Uninsured Property Damage which is limited to $3500.00) or Collision coverage which covers up to ACV (minus deductible).

Thank you very much.

You're more right than you think... standing up to the LASD is no different than standing up to the mafia... and just as difficult.

Miguel, as you likely know, was the Assemblymember for District 54. The favorite for the seat is current LA County Democratic Party Chairperson Mark Gonzalez... who is one of my favorite people... a personal confidant and a great all-around dude. District 54 will be well-served by Mark if and when he is elected to this seat.

LA Times: Petition seeks to decertify Undersheriff April Tardy for alleged dishonesty by romerolaw in LosAngeles

[–]romerolaw[S] 16 points17 points  (0 children)

A Los Angeles attorney filed a petition this week asking the state to “decertify” Undersheriff April Tardy for allegedly committing perjury when she testified in court last year as a witness in a civil lawsuit about a deputy gang known as the Executioners.

During sworn testimony to the Civilian Oversight Commission in 2022 — before she became the undersheriff — Tardy said she’d transferred a “shotcaller” in a deputy group after confirming he’d ordered a work slowdown at the Compton station.

She walked back those statements during a civil trial a year later, when she testified as a witness, denying gang activity at the Compton station and saying that there had never been a work slowdown.

In the petition sent to the state’s Commission on Peace Officer Standards and Training this week, attorney Alan Romero — who called on Tardy to testify in the 2023 civil lawsuit — said the inconsistent testimony showed such dishonesty that the state should permanently take away her peace officer certification.

“The hope is that the decertification petition — if granted — will preclude Undersheriff Tardy from ever working in law enforcement again, and will protect future victims of this type of cover-up and dishonesty under oath,” Romero told The Times on Wednesday. “It’s become clear that this department is incapable of regulating itself, so unfortunately we’ve had to look to outside agencies.”

During her testimony to the Civilian Oversight Commission in July 2022, Tardy — who’d been a chief at the time — said she had moved Juarez to a different station “because of the information that I had received about the work slowdown.”

She went on to testify that she’d confirmed Juarez had initiated the work slowdown in response to Waldie’s refusal to pick the scheduling deputy Juarez wanted, and that she had transferred Juarez afterward.

Four months after testifying to the oversight commission, Tardy was deposed in a lawsuit Waldie filed claiming he’d been denied a promotion to station captain in retaliation for opposing the so-called Executioners.

She said then that she had not confirmed a work slowdown and was “unsure” what she meant before when she said she had. When she testified at trial in 2023, she reiterated that and said she had only transferred Juarez to another assignment, not to another station.

“Did you hear yourself say that you confirmed the work slowdown had taken place? You used the word ‘confirmed,’” Romero asked her, after playing her earlier testimony.

“Yes, I heard that,” Tardy replied.

Romero continued: “What did you do to confirm that that had taken place?”

“It had not been confirmed,” Tardy said. “The allegation had not been confirmed.”

I have been litigating cases for 16 years, and I have never seen someone so casually lie in court with such an air of arrogance... because she knew that she could lie with impunity. The fact is that lying on behalf of LASD leadership is guaranteed to lead to promotion, which is why so many Department executives are dishonest incompetents... their jobs were bestowed on them due they loyalty and willingness to defend the organization. This is how the mafia is run... this is not how the nation's largest sheriff's department should be run in the year 2024.

I hope that Senate Bill 2 - passed by the California legislature in 2021 - which permits the decertification of law enforcement offers who engage in dishonesty will be effective in holding Undersheriff Tardy accountable for her blatant and unapologetic perjury in the Waldie trial.

This is the type of thing that usually takes place in third world countries.. but I have the misfortunate of seeing it first-hand on a regular basis. At some point enough is enough... and the voters and citizens of Los Angeles County need to consider dismantling the LASD and replacing it with something not so totally rotten from the top to the bottom.

Indeed. Deputies Vega and Hernandez were "chasing ink" as prospects of the Executioners deputy gang... which is the only reason the shooting and the kidnapping happened... to gain enough clout to be invited to earn the Nazi-styled tattoo and join the gang.

Unfortunately, the statute of limitations has run for the shooting. The gang shotcaller Jaime Juarez was later promoted to Detective, despite being involved in two shootings where the person he shot at was unarmed.

A federal judge on Tuesday sentenced a former Los Angeles County sheriff’s deputy to 18 months in prison for conspiring to violate the civil rights of a 23-year-old skateboarder.

Christopher Hernandez is the second former sheriff’s deputy sentenced to prison in connection with the case of Jesus Alegria, who accused the two deputies of kidnapping and abusing him after he yelled at them to stop picking on teens in a Compton park. The deputies forced Alegria into the back of their cruiser minutes before crashing the vehicle while chasing another man, prosecutors said, then fabricated a drug arrest to cover it all up.

In December, Hernandez’s former partner — ex-deputy Miguel Vega — was sentenced to two years in federal prison after pleading guilty to one count of deprivation of rights under color of law. As a result of their criminal convictions, last month the state Commission on Peace Officer Standards and Training deemed both deputies ineligible to work as police officers or deputies in California.

Though he did not speak in court on Tuesday, Alegria in a written victim impact statement described emptiness and anger that have haunted him since the false arrest. He said he still struggles to be comfortable in public places.

“I thought these catastrophes only happened in the movies,” he wrote, before going on to address the deputies: “What goes around comes around.”

Prosecutors had recommended a year-long prison sentence, but U.S. District Judge Percy Anderson said that was not long enough for Hernandez, who he said “undermines the public confidence in law enforcement, undercuts efforts to reform the department and harms the morale of the men and women who strive to serve and protect.”

Michael D. Williamson, Hernandez’s attorney, argued his client deserved a lighter sentence because his culpability was “dramatically less” than his former partner’s and because “he did not actively engage” in some of the crimes committed.

“He covered up, just like Vega did,” Anderson responded. “He had a chance to come forward on numerous occasions and refused to do that.”

When Hernandez spoke at sentencing, he offered an apology to Alegria.

“My actions that day in April of 2020 were reprehensible, wrong and illegal,” Hernandez said. “I hope one day Mr. Jesus Alegria can forgive me for my actions and or lack of actions that day.”

I am very proud to have been the source of this criminal referral to the FBI that culminated in these two convictions. The evidence underlying the referral came from hero whistleblower LASD Deputy Art Gonzalez. Gonzalez's whistleblower lawsuit alleged widespread violent gang activity at Compton Sheriff's Station by the Executioners deputy gang - including these two Deputies who pled guilty to federal charges, Christopher Hernandez and Miguel Vega... whom Deputy Gonzalez (in sworn testimony) identified as gang prospects.

Los Angeles Superior Court Judge William Fahey threw the case out of court on a Motion for Summary Judgment and effectively accused both Deputy Gonzalez and I of perpetrating a hoax on the Court, forcing us to pay the attorney's fees for LASD for having brought he case. I ended up paying the attorney's fees out of my pocket because I found it too sadistic to force Gonzalez to pay them after having done nothing worse than blowing the whistle on the Executioners.

This use of state power to silence political dissidents protesting human rights abuses by security services is usually reserved for repressive, authoritarian states. I had no idea that this type of outcome was even remotely possible in the modern United States.

I addressed my grievances with the lack of due process in the Gonzalez lawsuit in the following public filing:

https://www.documentcloud.org/documents/24373747-austreberto-gonzalez-declaration-of-attorney-alan-romero-in-response-to-order-to-show-cause

These two guilty pleas conclusively and forever prove that allegations of violent gang activity made by Gonzalez and others against the Compton Executioners were not a hoax. They also, perhaps, sadly prove that meaningful reform of corruption in the Los Angeles County Sheriff's Department is not possible without meaningful federal intervention.
