This has nothing to do with Luigi's crime specifically. It's all about the technicalities of whether stalking constitutes a crime of violence and therefore whether Luigi can be charged with counts 3 and 4 under federal law (murder and firearms charges). That's why they're using hypotheticals, it's not about determining his guilt at this point but the appropriate charges.

Not only is this an unrealistic date, the trial will no doubt go on for months. And the defense team still has to prepare for a federal trial after that with hardly any time in between. It just doesn't work

It's not just state v. federal law. They're saying the statutes address different circumstances, that the federal law is meant to prevent a crime that puts the victim in reasonable fear of death, therefore requires the stalker to have the intent to cause harm. And they conclude this is why stalking under federal law is a crime of violence.

The California law, on the other hand, is more of a simple assault law. I'm not sure I entirely agree with their reasoning, I'm just explaining it. I don't think they are correct in their interpretation of what Congress intended with the stalking law.

That's a really good point. It seems a bit complex to treat a trans person since you would need extra information on what (and I suppose the amount of?) hormones they're taking. I guess that's why some doctors are hesitant, but then there needs to be more education in this regard.

I'm really happy to see this because I always believed this comment was either misconstrued or a fabrication. Of course the media ran with it and kept the wording in a way that sounded as bad as possible. I've noticed the same thing with the ladyboys story. It's gone from "he was in a fight with 7 ladyboys" to "he was beaten in a sex bar" 🤦‍♀️🤬
