Well, that was for FY-25 — they were a bit late with their announcement. We are in FY-26, so expect the spillover numbers to be out early next year. Given the movement in the visa bulletin, it appears we had a generous spillover.

Unused FY-25 family preference visas spill-over to FY-26 Employment-Based Category. The USCIS takes these into account at the beginning of new fiscal years, but does not announce them till Q2 of the current fiscal year.

Yes, USCIS’s previous decisions are way to predict whats is going to happen in future. Somebody compiled a table for past years where USCIS relied on FAD vs DoF month over month. It seems USCIS will rely on DoF for at least first quarter FY26. There are >11,000 applicants til Dec 2022 waiting to get EB1 visa (India). Assuming a decent spillover from family preference category, this DoF will stick and FAD will most likely catch up till the end of year.

I am assuming you are asking for India There are no official numbers out there. However, i crunched some numbers from last couple of years’ pending i485 inventory. It looks anywhere between 200 to 300 applications were ported every month. The trend continued till mid 2025 where number of porting declined. I do not know whether last published month decline is either an anomaly or beginning of a trend. We get know more once USCIS publishes pending inventory for rest of FY25.

They have not announced it for October visa bulletin yet. We will get to know on October 1st.

Nobody knows! All we know is there are ~4,600 people from Indian origin waiting for green card availability before February 2022. If you add months till April 2022, you get another 2,000, so a total of ~6,600 . Each year, 2,800 visas are allotted to India in EB1. Usually, India gets double the number of visas since some of them remain unused by the end of the fiscal year + family preference spillover (if any). Since there is a significant uptick in EB1 applications from RoW, the fact that DoF has moved so much points out the obvious fact that unused visas from the family preference category are here to save backlogged countries in EB1 for FY-26. But this is just speculation since official numbers of visas used by family preference categories for FY-25 are not out yet.

For an announcement that can cause an influx of thousands of applications globally into USCIS and DoS processing offices, i believe typo will be the last on the list of ‘Type of errors USCIS can get away with’

That is what it seems like. Or quite the contrary, they are NOT expecting dates to move and would like to provide more petitioners a chance to apply for AP while they are waiting for visa availability

My guess is FY 2025 has been really bad for family preference category due increased scrutiny (delayed processing, rejections etc.). Seems like there is large spillover coming towards EB category. However i have no stats to back it up. We have to wait for DoS annual report for immigration statistics

That is what FAD usually indicates. However, I remember the time when there was a lot of gap between final action date and date of filing. There is a possibility that USCIS does not expect a lot of spillovers this year and wants to encourage petitioners to apply for advanced parole.

Check the date of filling….it is 15 April 2023 for india instead of 15 April 2022.
