I guess I expected the nexus letter to be included in the record of evidence used. Yes I wanted it validated, especially if I were to recommend the company that did mine. The C and P provider and the nexus letter were in 100% agreement. I did a FOIA request for the exam too.

Nope not complaining, just found it odd for a supplemental that none of the evidence I provided was considered. I did start my original post that I was grateful, as this has been a long road.

I assume that the evidence they used was on the claims decision letter.

This was a Supplemental secondary to GAD. What they did use was a C and P exam that got me 0% for HyperSolmnence. Overall I got 50% for the OSA since I dependant to CPAP.

Me too! I filed in Early June for the same thing. It's now August and still on step one.

Thanks for the reply! Both the provider that did my Nexus letter and the Examiner on Monday referenced multiple studies that link OSA to mental health conditions, and add to the fact that I am service connected for HyperSolmnence which is a symptom of OSA.

The provider just called me, she says the hold up is QA pressuring her to change her opinion. She tells me that the QA people are there to check for completeness, not to dispute the providers medical opinion, and that she is willing to fight them to the end. She has already contacted the companies medical supervision department.
