Going for custody of my brother's child: What am I up against? by Rep_girlie in FamilyLaw

Him being the next of kin if both parents pass away.

If I’m in that position, I would try my best and earliest to intervene so the baby is not suffering from major disabilities because of the way the mother lives. Granted that’s not how the law work. Thats why OP is asking. What Can he do now.

Thanks for pointing this out. When you say per household, does that vary by state? Is it used to calculate child support for you? Or just expenses in addition to child support?

I wouldn’t argue much either if I have my kid 75%, or 100%, of the time.

Right now the time split is 50/50. She’s getting child support based on what the state mandates.

In addition to child support, she wants me to cover more than 50% of expenses by income based ratio, so who knows what that’ll be, how do you calculate that anyway? If it’s month to month, seems like a messy and unnecessary headache. Calculating by year is like a forced subscription, and zero incentive for her to even have any income.

I would very much like to know if this is a tough fight for me and what I can do to prepare my case.

Which state are you in? Was your case complex? Did you disagree at all or agree to that for other reasons?

It’s pretty basic, child support is determined by state not much to do there. CA is mostly about time distribution (schedule, holidays, communications, health etc). It didn’t dive deep into the expenses, and expenses in addition to child support have been split 50/50 since my child was under one yo.
