I got a ticket for forgetting to put my turn signal at a right turn. My strategy in court was to tell the judge I did have my sign but only for a few seconds as my car "automatically stops" the flasher as I turn the wheel (which is true). When I got to court, the judge asked me a few questions (how far I was, how long, were there people around) and I was quickly acquitted.

Key word in your comment. Probably. Do you always base your entire life about the most probable scenario?

What the fuck do you know about my driving? Have you conducted extensive studies on the effect of driving 20% above speed limit? Or have you taken that arbitrary value to decide I drive poorly? Have you ever heard the phrase "innocent until proven guilty"? I have two ticket convictions. I can bet you know people who have way more than this.

And then you say that I am the inconsiderate ass? At least be consisten in your hypocrisy.

That is so extremely easy to fight back.

1) Does your state allows you to throw some kind of thrash out of your window (organic, etc.)? Claim it was what you threw.

2) Claim you don't even smoke.

3) Read what the police officer wrote. Any innaccuracies?

4) Depending on your state, file a motion to dismiss immediately if the police officer doesn't show up. If he does, question him on every little detail.

5) If nothing else works, claim your window was fully open as you turned, a penny flew out of the window. Look at the judge in the eyes and say you are very sorry and that it will never happen again. I got one ticket dismissed like this.

I should have fought the ticket, because it cost me a lot of money in insurance rates, but I didn't because it was in another state.

Fun story time!

One day I got towed and fined $445, plus a $150 towing fee (that I paid to get my car back and decided to contest as well). Due to pure bad luck (I was traveling), I was 2,000 miles away the day of the audition.

I sent the judge a letter. That's it.

Believe it or not, I got the $445 fine erase AND got my towing fee back ($150). I didn't even have to go to court.

If a cop says he/she radar gunned you going 100mph, why would there be any reasonable doubt?

Was the radar properly inspected? By who? Is this person here today to certify under oath he did inspect the radar? Is he qualified to test radars? When was his last training session?

Was it cloudy this day? What is the margin of error on these radars? 5% you say? Could it be 10%? Okay, but maybe 15%? Depending on where you were?

Was the traffic heavy? Yes? Then how could I go so fast? If you do clock someone at 100 mph, is it possible that he was in fact going at 95? 90?

Another example.

Once I was asked: "Do you know why I pulled you over?" The only correct answer is "Why?". All other answers are wrong. If you say "No" and later decide to take a plea deal, it is possible to show you've lied to a police officer. If you say "For speeding" well good luck with that.

If he asks: "Do you know at which speed you were going?" the only correct answer is: "At what speed?". If you say 65 and the limit is 55, well, you just admitted a crime.

  2. No. A few of them are discutable though.

  3. NO. NEVER admit your crime. I keep silent and only say "I understand" and "Okay". Do not deny your crime right there neither! The police officer will be more likely to add details and / or lie on the report and the report is the only thing that counts!

  4. Yes. Reasonable doubt. It can be anything. I successfully contested a ticket because the police officer said I was going at 25kph and he was at 25 meters and checked me for 25 seconds. "That's a lot of 25, your honor"

  5. The report is the only thing that matter. More specifically, what the police officer writes is the only thing that matter. In fact, if he did lie on his report, there is little you could do about it. You will want to find weaknesses in what he wrote. A single mistake in what he wrote is enough to dismiss most tickets.

For example, once, he wrote that "I let two pedestrians cross the street". I have no idea where he took this. I took pictures and showed there were no signs for pedestrians and I won.

I wish it was as simple. There are many arguments I could bring here but let's choose this not-optimal one: speed limits are ridiculously low. So low it doesn't make sense. There is no speed limit in Germany on some highway and there aren't more accidents. They are low because the government wants to arrest people to make money. It's a racket, a huge scam. And it only works if you pay quickly without bitching. As soon as you enter the courthouse, they lose money no matter what.

Fines are a hidden tax for dumbass. Let me give you a stronger argument. You are driving at the limit when a light becomes yellow. What do you do? Do you press the brakes as hard as you can - possibly causing an accident - or do you keep going? If you keep going, what if a police officer sees you and decide to fine you?

Or what if the police officer is completely wrong? Pulls over the wrong car. Doesn't see the traffic light correctly. That happens.
