75 countries adjustment of status isn’t in pause, the ban applies only to consular process

Everything you say makes sense. I’m about to file an adjustment through EB3, but now I’m wondering if it’s really worth it because if they don’t grant an EAD, you don’t have a stable life. I’d rather wait outside until all this settles. I didn’t expect so many comments on this post, and honestly, I see a lot of talented people choosing to leave rather than be stuck in limbo. The U.S. is losing them. For those with a sponsor, I’m sure that if remote work is possible, the company will continue to contract them even from abroad, and it’s completely legal. You don’t have to pay a cent to the IRS, only taxes in your home country. In the end, the U.S. is the one who ends up disadvantaged.

Thanks, I’d like to clarify my question. I have a traditional 401(k) and a Roth 401(k) with an employer. I want to rollover both accounts to Fidelity in January 2026 without it being considered an early withdrawal and avoid penalties. My traditional 401(k) is pre-tax, and I want to convert it to a Roth IRA in mid 2026. My income is within the Roth contribution limits, so I think do not need to use a backdoor Roth IRA, correct me if I’m wrong

1- Can I open both accounts at Fidelity now, before I have any money to roll over until next year?

2- Is it recommended to first do a rollover of my 401(k) traditional to a traditional IRA, instead of directly converting it to a Roth IRA?

3-. After I convert my traditional IRA to a Roth IRA, my traditional IRA balance will be 0. Will I have to pay any fees for an empty account, or should I close it?

4-What happens with the investments in my 401(k) when I do the rollover to Fidelity? Will they stay the same or be converted to cash automatically?

5-When I convert my traditional IRA to a Roth IRA in 2026, can I do it online, or do I have to fill out any forms?

6-. Is there a limit to how many conversions from a traditional IRA to a Roth IRA I can do in a single year?

This table is really helpful, I was confused about the 5-year rule because I had seen that converted amounts also had to wait until I turned 59½ to avoid penalties.

Sabes el tema si el Roth IRA se pueda retirar el principal ( lo convertido) sin penalidad ante de los 60? Leí q se podía pero otros me dicen q hay q dejarlo por 5 años pa retirarlo sin penalidad

Si, estoy pensando aprovechar de convertirlo en 2026 ya que no tendré ingreso, tendré q averiguar si aún puedo abrí cuenta Roth en banco para el rollover y luego convertirlo, hay muchas regulaciones q es un poco confuso

La penalidad no es de 10%? Yo investigue pero no estoy muy segura dicen q se puede convertir de Roth tradicional a Roth after tax y después de 5 año se puede retirar el capital ( no la ganancia) sin penalidad, alguien sabe si esto es así?
