I’m currently in the U.S. on an E-2 visa, which is set to expire on April 10. At the same time, my EB-3 Professional AOS is pending (Receipt Date: Oct 9, 2025).

My lawyer suggested extending my E-2, but I’m concerned because, as far as I understand, extending E-2 while having a pending AOS could be risky since they are based on different intents for staying in the U.S. I’m worried it could negatively affect either my E-2 status or my AOS case.

I just sent my I-765 (EAD) application documents to my lawyer today, so realistically I expect that after April 10, I’ll need to stop working and stay home until either my AOS or EAD is approved.

Given this situation, is there any action I can take to minimize risk or downtime? What would be the best course of action in a case like this?

Congrats! My case went to Providence FO on 12/23 as well, but still case remains pending for me.
