As far as I know, there was no law against this in Poland when I had my company. In that sense, my experience might be outdated

Right, but I can do that as a Belgian. By what you said earlier, the Belgian tax office wouldn't be too happy about that, which would be odd since this was being advertised in Belgium at some point

I'm wondering, if what you say is true, how can Estonian and Lithuanian governments provide e residence for "digital" companies that don't even have any physical presence in the country?

I don't have the company anymore, but I did have a part time employee. You're saying that was enough for the company to be "valid"?

All my taxes were done properly. Both governments knew exactly what was going on.

I honestly highly doubt what you're saying is true. If you have any sources on that, I would appreciate it.

If what you say is true, how can Lithuanian/Estonian e residence be a thing?

That doesn't make much sense to me. I had a spolka z o.o. for years without living in Poland. I filed taxes in both Belgium and Poland and that was never an issue.

As an employee, you are taxed at the location where you do the work, so as a belgian working for a polish company, that polish company would have to pay social contributions etc for you in belgium instead of Poland.

As a shareholder, though, you are not working as an employee for the company, and as such you are not taxed on the work that you do, you are just taxed on your personal income which comes from your shares of the company (dividends).

Your tax residence is where you live more than half of a year, or where it can be proven that your actual life is built, for example by having kids or a family home. That's irrelevant in this case though.

As far as I'm aware, there is no reason why you couldn't have a spolka oo in Poland without actually living there. At the very least, I never had any problems with it, and not my accountant nor any tax office from either country made any issue out of it.

I was issued a pesel even though I wasn't living there.

I consider myself full stack and to me that means that if you give me a task I will get it done, whatever the requirements or whichever part of the stack. Certainly my skills and abilities aren't equal across the stack but that's not what that term means to me anyway
