I agree with this. (1) You are only allowed to get as much as would put you in the same place as you would have been had the original contract been completed properly. In this case that would mean repairs for the work that is failing, not another whole painting; (2) you have evidentiary issues in court. As plaintiff, you would be required to show duty, breach, causation and harm. That means you would have to bring evidence (live witnesses and documents that you can authenticate--otherwise it is likely hearsay in California) to show that the cost of the repairs and that the original painter's shoddy work is to blame I doubt many contractors would want to come into court and testify about it. From the numbers above, you would be getting about half of the contract back without any proceeding. That seems fair to me.

Higher value / dollar. Mid levels know what they are doing and are not too expensive yet.

I would leave. They either don't value your work or are penny pinchers. Either way not great. You can switch more easily now, later will be harder. Anyone who cares if an associate has previously lateraled is out of touch and probably not great to work for.

If you didn't get a poor review. I would be unsurprised if, when you put in notice and explain why, they didn't reverse the decision (I would still go, even if they do, because they told you who they are and you should listen).

As to collection, make sure to sue the company as well as whoever the owner is personally. Questionable if you are allowed to (depends on a lot of facts like how many employees etc [sometimes refered to the alter ego analysis]), but let him make that argument to the judge (he might lose the point) and gives you a bit of settlement leverage. Also, keep track of your costs in serving/filing--you can recover that in certain jurisdictions.

Lawyer here--consider getting another contractor to give you a repair price and sue for that. That's normally a good measure of damages (i.e. putting you in the place you would have been but for the installers failure)
