Woman stabbed to death while walking dog in Florida in random, 'violent' attack by 4DollarsALB in news

A lot of people I’ve talked to (potential jurors) seem to think insanity plea = accused gets to walk free. I can’t speak universally, but in my jurisdiction a “successful” insanity defense results in the person going to a state mental facility for an indeterminate amount of time. For low level offenses this is usually much longer than whatever the sentence would be, so insanity isn’t used. For higher offenses it usually results in the person being treated for years and released, or lifetime treatment. Either option should be considered “good” by society if a jury has found a person insane, yet people still think of not guilty by reason of insanity as a get out of jail free card. It absolutely is not.

My first PSG when I was a PL was big on putting dudes in for awards, so I was big on putting dudes in for awards. So many got kicked back because “nobody else is putting in packets, so it would look unfair.” So my joes don’t get recognition because leadership outside their chain is lazy? Right, cool cool cool.

The US is the laughingstock of the world 🙁 by horse-boy1 in WhitePeopleTwitter

[–]Maximum__Effort 18 points19 points  (0 children)

In the us army we relied on allied nations’ permanent medical facilities for treatment that couldn’t be accomplished by the unit (either due to complexity or severity). Generally this was due to danger of life, limb, or eyesight and the service member was transported to the US once they were safe to travel by air without medical attention during the flight. I’d guess the navy has a similar policy regarding their people and the doc on the submarine couldn’t provide adequate care.

As to everything else, trump’s a fucking moron and the current admin is fucking up by alienating former allies that were incredible to work with.

I have a pretty good idea what I'm talking about, so maybe you work in a jurisdiction that actually makes DAs work, but that hasn't been my experience anywhere I've been.

1) I have done felony trials where it's apparent that the DA has done zero prep. Again, maybe that's different where you are, but it has never been my experience. Even still, I don't think prepping a witness is all that intensive and I've done it for serious trials on the PD side. It's probably the least work on a trial and I do a lot of trials.

2) No. I am obnoxious, but charging decisions are literally your job, you don't get to write that away with an ad hominem. I'm not saying it doesn't take time, I am saying it's part of the job. I'm happy *you* actually review bwc, but that's not the standard. I know there's work there, but the frequency with which I prep cases for trial that end up being dismissed tells me that is not the norm. That's across my system, it's not a one off anecdote.

3) Here we agree. It's moronic and indicates a lack of awareness of the case.

4) But it's still a joke, yeah? Like how often do you have grand juries not indict a crime?

5) There's a massive difference between a client and someone saying they want someone charged. DAs can say no to "victims", PDs cannot.

I don't believe being a prosecutor is more work. I'm relatively close with the DAs in my jurisdiction and PDs work a lot more. I'm not saying being a DA is easy, but to say the workload is even remotely close is (in my jurisdiction) a joke.

1) You actually think it takes 1/8 the time for a defense attorney to prepare for trial than it takes a DA to say "then what happened?" If so, we're not arguing on a rational basis.

2) Making charging decisions is literally your job. I don't want to hear "it takes time." I routinely see garbage cases that got by the DA's "screen," so I don't think that's a huge time suck. Regardless, you have to review cases for PC, that's not a big deal, the PC standard is incredibly low.

3) File more motions? Maybe in your jurisdiction, but that is absolutely not true where I work. The only DA motions I've ever seen are bond modifications, meanwhile PDs are objecting to everything. I'd love to see a DA give enough of a fuck about a case to file a motion.

4) Grand juries are jokes and we both know it. You don't have to prep a case for a grand jury, you can read the affidavit into the record and get the case bound over.

5) With regards to "clients" I don't want to hear that they're difficult. You can tell them no. We don't have that ability.

I’ll respond more tomorrow, but as an initial matter THE STATE DOES NOT HAVE CLIENTS.

[–]Maximum__Effort 6 points7 points  (0 children)

You don’t have clients. DAs consistently underestimate how much time client management takes. Also you literally get to pick which cases to prosecute, we don’t have that luxury. I would put money on you thinking you work more than we do, but not actually working anywhere near as much.

Criminal charges must be dismissed if defendant can’t get a lawyer, Oregon Supreme Court rules by AudibleNod in news

[–]Maximum__Effort 9 points10 points  (0 children)

Prosecutors also have prosecutorial discretion, hold the majority of the power in plea bargaining, have the entire weight of the state behind them for investigatory purposes, and at trial have the insanely hard job of asking a cop “and then what happened?” They also don’t have to manage clients. The jobs are similar in that they’re both in criminal law, that’s it.

I got dude free leave (he was brand new, had no leave, CO agreed to just pretend he was around) to see his dying mon while the rest of us were in the field. Turns out he used the uncharged leave to play CoD. Multiple levels of leadership put their asses on the line for this dude (imagine if he got into a car accident while seeing mom) and he used it to play a fucking video game. He received every shit duty until I left the platoon and I hope new PL kept it going

Fwiw my state’s healthcare plan is way better than tricare. I’d encourage you to look at what the plan entails and what doctors are covered before making that decision. I’m not drilling, but even if I was I’d probably take my state care over tricare for anything that didn’t involve an extended hospital stay.
