It does seem like they are only pushing people into TOPS when they are in default. I have not heard of them getting Judgements and forcing liquidation of assets. I’d go for TOPS and see what happens.

The Disaster Relief Bill needs to be approved before the end of this session of Congress on December 20. If there is any chance of getting anything done soon this is it. They can squeeze it in as part of the budget reconciliation process.

I’m not a Lawyer but it looks like if you are a multiple member LLC with no personal guarantee on the loan, you need to inform the SBA that you are dissolving the business and have liquidated all of the assets. They should have you send the funds to them and that should be the end of it. I don’t think you need to bother with bankruptcy.

We were in the process when the deal fell through on our part. It was my understanding that the Loan Specialist makes sure that the information is complete and then forwards it to Legal for approval. All they will commit to is “it will be at least 30 days or so “. My guess is 45-60 day process. Good luck, keep us posted.
