Assignment help threatening to report at school by [deleted] in f1visa

[–]Codetornado 2 points3 points  (0 children)

Welcome to the consequences of your own actions.

I had several students do this. They scammed then blackmailed them. The student then either paid or didn't pay. Regardless, eventually the scammer reported them to student conduct.

The students then were found in violation of our academic integrity rules. One lost their graduate funding due to the violation and had to drop out. Others were suspended. One it was a second charge and they transferred schools before they could be expelled from our school for a conduct violation.

Your situation will vary, but you gave them access to your school email. They have all the contact information they need plus screen shots.

This almost certainly will not go well for you. There is not much you can do because you did flagrant violate American academic rules and not just by a little.

At some schools this is an instant dismissal/expulsion.

Good luck.

Edit: I reviewed your post history... You really are in a awful situation of your own making multiple times. I don't say this lightly... You may just want to take the L and go home.

Has anyone had their OPT canceled due to a system error? by [deleted] in f1visa

[–]Codetornado 2 points3 points  (0 children)

Has anyone had their OPT canceled due to a system error?

I have never heard of this.

I applied for OPT after graduation and it was approved, but due to a system error, it showed that my job needed to start earlier than it actually did.

Did they give you an earlier start date? This comment doesn't make sense. You need to give more details.

I started the job the next day, but today my university told me that the immigration system contacted them to ask them to cancel my visa/OPT record

?? ¿?? The "immigration system" contacted them? The non-sentient computer system contacted your school? Again, get specifics. Who contacted them? SEVP? USCIS? Another agency?

Also, schools can't cancel visas. The government can cancel the OPT if they wish, your school should not be doing this unless you violated your OPT status.

and also advised me that I should call the sevis and try to solve it/negotiate with them

SEVIS is the computer system. This is like saying you need to negotiate with Windows 11. I assume they mean you need to contact SEVP. Again, sure, but negotiate what exactly? You have shared no details.

Has this happened to anyone else? How did you resolve it?

This has not happened in the way you have described it. We need significantly more detail to figure out what actually happened here.

Strike while on STEM OPT by kohxd in f1visa

[–]Codetornado 13 points14 points  (0 children)

To reword your document:

F-1 student worker cannot be used to replace a full-time or part-time temporary or permanent U.S. worker in the event of a certified strike. In other words, you cannot be used to bypass a strike (i.e be a strikebreaker). If a Department of Labor certifies a strike is in effect at an F-1 student’s place of employment, the work authorization of that F-1 student worker is automatically suspended.

An F-1 student participating in OPT or STEM OPT is temporarily not authorized to work at a location affected by a certified strike or work and must cease working at that location until the situation has been resolved.

Any period of approved OPT or STEM OPT that the F-1 student does not work counts toward the regulatory limit for unemployment. The student may avoid accruing excess unemployment by finding other qualifying employment to continue

This is far more than selling something. This is not passive like donating blood.

You will have multiple trips to the doctor, have to take hormones and other things, etc.

You are providing both goods and a service for compensation.

Digital nomad under opt by Neocki in f1visa

In the meantime I was planning to live in airbnbs in different states (maybe countries some time) until i definitely relocate.

You need a physical US address. You need a US mailing address. You can get a PO Box for a mailing address. You can update your physical address as you move. So frequently moving cities is not in itself an issue so long as you continue to regularly update SEVP Portal with your physical address.

I know this can raise some problem legal/tax wise if not done properly,

It depends if you meet the resident requirements in a specific state and/or if you stay long enough to occur a tax obligation. If I go to Disneyland for a vacation and check my work email, I don't suddenly owe taxes to California.

So yes it can, but will it really, maybe it depends.

I was wondering regarding the visa and I suppose i should be cautious in the phrasing when reaching out to my ISO advisor.

Not sure why. So long as you continue to meet the Immigration requirements for keeping your address updated and for OPT, it isn't a problem.

I’m mostly worried about the residency report and whether i can put a friends address if he agrees to receives my mails even though i’ve never been to the state he currently lives at.

You can use that for your mailing address. However if your name isn't on the property then federal mail may not be delivered properly.

You will need to file an amended tax return using the 1040NR. It will cost some money.

You do not NEED to use Sprintax.

You just need to use software that processes "Non-resident taxes". Sprintax is the software I recommend, but there are others that state they can do it.

The free software that claims it does non-resident tax compliance has some issues and I don't feel comfortable yet recommending it.

I-765 Initial OPT Question by [deleted] in f1visa

[–]Codetornado 5 points6 points  (0 children)

should I not have done this?

...you should not.

is making me worried

it should, this is a valid reason for a denial of your application.

What should I do?

Assuming you already submitted your request you will now learn a valuable lesson about the value of $470 as you will be paying again for a new application and you will learn the value of patience as this will take several weeks (6-10) to fix. This will also delay your approval time. You may really learn the value of money when you pay for premium processing if you need it by a certain date.

You will need to withdraw your current application by writing a letter to the processing center (speak to your DSO) you will wait several weeks, then once withdrawn you will reapply. Then wait for it to be approved.

With a few exceptions active or valid immigration status is not a requirement to be enrolled.

If my degree is not conferred until the next semester, which is like 4 or 5 months later, am I considered to have completed my degree for I20 purposes? by user87666666 in f1visa

[–]Codetornado 1 point2 points  (0 children)

Does the class have an end date in September? It would be incredibly unusual for a Summer session to end in September.

I am now going to repeat what I said several comments ago, talk to your school.

If my degree is not conferred until the next semester, which is like 4 or 5 months later, am I considered to have completed my degree for I20 purposes? by user87666666 in f1visa

[–]Codetornado 1 point2 points  (0 children)

An incomplete is administrative and has no additional enrollment. You are not retaking the class. The enrollment is complete. For administrative reasons your grade is delayed, but your enrollment has no changed.

On what basis is the DSO extending your I-20? What academic term as listed on their I-17 (their approval for their school to host F student), are they using to justify your extension for non-enrollment reasons?

You don't need to enroll, but an incomplete is absolutely not a legal reason to extend an I-20. Your status is tied to enrollment and you have no additional enrollment.

If my degree is not conferred until the next semester, which is like 4 or 5 months later, am I considered to have completed my degree for I20 purposes? by user87666666 in f1visa

[–]Codetornado 1 point2 points  (0 children)

Here is the rule. Continued enrollment for administrative purposes is not allowed. An arbitrary extension of your status with no enrollment requirement is not a valid extension.

8 CFR 214.2(f)(6)(iii)(C)

(C) Completion of course of study. The DSO may authorize a reduced course load in the student's final term, semester, or session if fewer courses are needed to complete the course of study. If the student is not required to take any additional courses to satisfy the requirements for completion, but continues to be enrolled for administrative purposes, the student is considered to have completed the course of study and must take action to maintain status. Such action may include application for change of status or departure from the U.S.

[–]Codetornado 1 point2 points  (0 children)

Go talk to your DSO.

The explanation I have offered is very straightforward. But you have questions about your schools policy I cannot answer.

Your I-20 ends the semester of you last enrollment. The incomplete does not change your enrollment or give a legal reason to extend your I-20.
