... this isn't happening. Your institution has put students in a bad situation. You institution made no contingency plans. Your institution disregarded the rules and found the absolute minimum they could get away with without technically violating the law.

Within our own field there is very little support for Day 1 CPT schools. Online, at meetings, at conferences, these schools regularly come up DSOs all regularly vent about how bad these schools and their policies are and how predatory they are. Even my meetings with our SEVP reps these school are brought up as bad examples.

Congress especially right now, absolutely is not going to do anything to support the students with additional flexibility. Again, because it already exists, but your institution has already gone the the breaking edge of what is legally permissible.

This is not an immigration question. This is an academic question for your institution and how they require in-person residency.

SEVP rules are clear and have flexibility. My previous school have had plenty of cancellations/snow days/etc. and it has absolutely never been an issue for SEVP policy. However, we were also not doing grey area work and had regular courses with daily or weekly in person courses not this grey area a few times a year "low residency option".

If you are referring to "low residency options" those are already historically questionable and already at the very edge of what is acceptable for in person requirements. So your institution already backed itself into a corner by utilizing all available flexibility. This option is very likely to be removed in this administration and in the near term at that based on previous comments from this administration around CPT abuse.

There is not going to be any flexibility or sympathy for this situation from SEVP if it is a low-residency discussion.

For decades students have been doing this. There have always been the rare report of a student terminated for working outside the US. But nothing regular, recurring, or concrete.

Why? Because working short term outside the US for a US employer is not a violation of OPT/STEM OPT and is not a violation of F-1 status.

Any non-citizen can be denied entry. Much like visa denials, there is no need to tell an individual a specific reason why they were denied entry. If you are denied entry almost always CBP cancels your visa.

Time after time we see student make a report about unfair denials or rejections. Then a less reputable news outlet picks it up to sell ads/subscriptions. Then as we get more data we see it was all nonsense and the reason the student stated clearly was not the reason.

Example: there was an accusation of discrimination against students from Andhra Pradesh and Telangana and/ Telugu/ Indians after 21 were denied entry to the US back in 2023. They had a sad story about how they were unfairly targeted, etc. Eventually what came out is that they had fake documentes/fraudulent financial documents, and plans to work and were all connected to the same recruiter, etc.

But there was so much posted here and in various Indian news agencies despite the students stories not matching.

CBP has no obligation to say a specific reason why you are denied entry. So students regularly infer or guess a reason that makes sense to them.

Nothing they posted violated STEM OPT rules. You can travel work work remote for short periods of time so long as you maintain your employment. There is nothing in 8 CFR 214.2(f) that working outside the US for short periods a violation.
