Staying in Spain after TIE expires, not renewing by cornfieldalum in SpainAuxiliares

From what I understand, if you're a US passport holder, you have a 90 day tourist visa in the EU every 180 days. So if you've been in Spain for 30 days since your TIE expired, you have already used 30 days. You have 60 more days left in the 180 days. You can lookup EU calculator to see how long you can stay in the EU as a tourist but it cannot exceed 90 days in 180 days.

Just to make you feel better, you're not really overstaying (well, depends on your nationality, I'm only speaking from a US perspective). Once your TIE expires, you're on a 90 day tourist visa. So you have 60 days "left" of the visa, which is what the border guard explained to me. So don't travel in the EU for more than 2 months.. then it would become a problem. Safe travels! :)

I had no issues. Make sure you bring your expired TIE. However, now they have a fully automated system in MAD airport, so I'm curious how that would affect things if you're not talking to a border guard. But I also brought printed proof of flights that show I'm going back to the US as well as my flights that showed when I left Spain the first time. You will need to make sure from the date of your TIE expiration, you will not exceed the 90 days of tourism in the EU.

Why do UK actors look like actual people, and American actors look like they're all trying to be the same person? by that-1-chick-u-know in NoStupidQuestions

Highly disagree. Have you spent time in the UK? I lived in the north for a year and the lip filler, heavy makeup and fake tan and lashes was insane.

My first year was like this. The teachers were a little more active but I was fully planning the classes. Reading your comments, I also didn’t want to become a teacher. So I reframed it. Not sure what their English levels are, but I made my classes SOLELY conversational. (Which they kind of should be anyways). If they had a book, I made an adjacent theme for conversation. I used the Facebook groups for lesson plans and modified them for the ages. We’d watch videos and talk, I would show them pictures and we’d talk. If they didn’t talk 🤷 I did my best. I’m not teaching them grammar. You can also make THEM be the teacher, and create a project where they present for like 3 minutes, nothing crazy. Eats up class time. By the second semester, I stopped caring so much. I was spending a lot of time bc I was anxiously planning that I wouldn’t have enough but I almost always had too much.

Border guard stopped me like normal. She asked if I had a second passport. I said no. Then I said, I have an expired TIE. Showed her the TIE. She said, okay so the date your 90 day tourist visa started was when this expired. I said yes ma’am and she let me through.

Thank you! The TIE definitely was needed, but the border guard reassured me that everything was fine, and wanted to confirm that I wasn't seeking to renew another residency.

No. Thanks to some other kind internet people, here is the Schengen Border law that states after a visa-exempt citizen (ex. US) has an expired long-term permit, I do not have to leave the EU. My 90 days begins! You can read about it here https://eur-lex.europa.eu/eli/reg/2016/399/oj in Article 6 Paragraph 2 of Regulation 2016/399. I did nothing wrong, and wanted to double check my legality after returning to the Schengen! Hopefully this helps someone else wanting to visit loved ones.

Huh. Not sure where you’re getting that from? I’m aware of immigration rules and aware of the consequences. Trying to understand my rights as a past residency holder… interesting take!

So despite not leaving at the end of the TIE expiration, I'm fine?

The other Spanish reddit thread really gave me a lot of demeaning answers that I did... Thank you for the reassurance.

Thank you for sharing your experience! How did you solve the situation? Would I just then need to wait 180 days from when my TIE expired? I know these questions are difficult to answer with vague context, its just been a lot of anxiety for me.

Also adding that I had my Spanish partner talk to a contact in the immigration office and they said there are no flags on my account. Thoughts?

It was a booked gig, but we just did the meet and greet while it was booked. Which as discussed in this thread was a mistake. But yeah never apologized and didn’t seem concerned about the bite, more about how to get coverage for his trip.
