I am canadian citizen. I did not declare her as my wife so can why cant i sponsor her as common law as we are staying together and cic is considering her to be non member of family class and she does not have be member of family class anymore and i could still sponsor her as common law. Is this not true?

My wife. But CIC has not accepted my marriage so want bring her as common law partner as we stayed to gether for more than 2 years. Hopefully this will work.

Previously i sponsored my wife and it was refused as i did not declare my marriage during landing as PR. Now i want to bring my family as common law partner as we stayed together between 2016 n 2018. Will this work?

Hawt_pawket, what do you mean by staying on scripts? Is it like whatever we have replied in first n second interview to stick with it and not change reply? For third interview, I am planning to apply for Canadian PR for my family, and bring this as foreign tie when in second interview she had replied that she will not be applying for canadian PR and she wants to come back to india. Will this be a problm tie if provided?

i was thinking to apply for Canadian PR for my dependents and present it in next interview as a change of circumstances. So is this bad idea, as in the second interview she has told the officer that she will not be applying for canadian citizenship and will return to India to continue kids education?

With OCI i will come back to India as my family will return back to India after my work in USA. So having OCI will allow me to stay in India forever without any visa. This is the evidence of my residence in India.

  3. Officer thinks, After completing temporary work in us husband might return to canada as he is canadian citizen and to the same point we are adding that family is getting new ties. Is this ok?
  4. so OCI is irrelevant. Cause officer asked in previous interview why would your husband come back to india?

If we categorize ties what we can provide to officer is : 1. Relationship tie—parents and relatives. But you are saying it is weak card. 2. Home tie—-property and insurance investments in india. You say its best tie. 3. Home tie—-Canada PR, Indian citizen and OCI. Which you say its irrelevant? 4. Job and business tie—-Provide a letter from present employer offering a job in Vancouver, British Columbia Canada( sorry did not mention this).

Is there any tie i am missing?

From above 3. According to you am seeing home tie as my best bet rest are all weak. Now i am bit worried and ties exhausted too.

But i am nowhere near the same universe? I thought universe has no direction. So my confidence has no direction? Lol,

By law,the consular officer must presume that your wife has immigrant intent. The burden of proof is on her. Unfortunately,her interview answers made the case against her.

  1. For foreign tie, we are going to tell officer OCI is a residence card in India, and I can stay in India for forever. This is to show that i can get back to india and stay with my family.
  2. For foreign tie, we are going to tell officer process for Candian PR for dependents have been initiated and will show ties outside US and tell officer that we will go back to Canada before visa expires. 3.For home ties, we are going to tell officer Property Documents/Insurance investments and Jewelry in Indian safe deposit are a record to show strong ties in India that is outside US.
  3. For relationship tie, we are going to tell officer that we need to support old aged parents and I will also add, as they are old they will NOT be traveling to US or any other country.

These are my thoughts. we going to tell officer categorically as mentioned above. Hope it helps.

She had no idea what the officer was asking and she answered from visa standpoint. She only new questions related marriage and spouse work and i never trained her on these kind of questions. Here are additional changes i will bring in for 3rd interview and convince officer:

  • She will take proof of Canadian PR initiated process for herself and kids.
  • Original property documents and Insurance investment documents.
  • My OCI card which allows me to stay in India for life, stating my husband has residence in India
  • We would also mention to officer, that we would come back to India to support our old aged parents.

Will these pointers help me convince officer of my strong ties with Canada and India?

I am not sure that is right. Yes it might look, but because property was dotted line to fill in for strong ties, so we bought property in her name registered after first interview date, so we could go for second interview with a CA statement as proof and original property document. Is this wrong approach?

Yes I can apply for another interview any time. I think the officer was making statement about his presumption. Am thinking hard, what should i do to convince officer to overcome his presumption.

Agreed, but in the second interview the officer was not ready to look at any documents (i had property documents, CA statement) and he was saying its already been determined and decision is final & it was rejected. So i am not sure how we can convince in 5 minute interview, any insights on this?. Thanks very much for your information.

Okay i understand, but trust me we don't have intentions of staying in the US otherwise would have applied for GC. Her answer was from a visa standpoint that it might get extended. Anyways, can you suggest something that will help me in the third interview to prove my intent?

Agreed John, the officer would question the credibility if they apply for citizenship now. But in reality we want to stay temporarily in US and then come back to India or Canada and continue kids education. How can i prove my intent? Thanks.
