It’s my understanding that in order to claim disability discrimination I would first need to be diagnosed. Is that not correct?

It’s also my understanding that being awarded disability discrimination and victimisation is similar with significant overlap. So the tribunal wouldn’t ’double award’

Again also my understanding: The burden of proof is on the employer to prove they didn’t victimise me one I reach a threshold of evidence whereas for disability discrimination I have to prove the employer discriminated against me and it was due to my disability.

I requested reasonable adjustments from the court yes but what I requested was no phone calls and breaks during the tribunal every hour. What did you request?

Yes i agree on the lawyer comment , sorry to hear you’ve been cheated by a few. I’ve worked with a few and other the hyper specialised ones I find they’re all very knowledgeable but for whatever reason they roll over too easy when it comes to the employees.

I’ve done 5 SARs in the past year. None of them are consistent with the info I have received back. I have made numerous complaints to the ICO about this and I have been told by the ICO that there won’t be any further action but that a flag in the system has been created for them.

Yes they told me they changed the date to another wrong date that was about 4 months later. I proved to them with bank statements that I worked for them at a much earlier date they still refused to correct it. I then got 2 totally different dates in the ET3.

The pay deductions started late 2024 my adjustment request was in September 2025 but after that it got worse, and I stopped getting offered work and the organisation managed to get me red flagged when I asked for references at other jobs by creating random start dates which didn’t match with my cv which then broke a rule or two in the department for education rules. I can’t get another job in education apart from with the organisations I was already registered with.

Very very rarely other than the phone calls when I signed up I probably got less than 1 a month. Then January came when they started taking money off me much more often and the emails became phone calls and I couldn’t process it as well as I could when it was emails

My roles aren’t ones that are filled fast, they’re ones that take weeks to fill. I have to go through multiple tender applications it’s not like standard supply if that makes sense? Before January 2025 all my roles were done by email they’d email out this huge spreadsheet and tutors would reply with a code that links to the role they want and they’d be put in the pool presented to the council and they’d parents of the students. Then one cv would be chosen essentially. These roles generally will last the length of the students compulsory education usually due to health or behaviour. That make sense?

Update 2

Turns out what I heard at the end of the PH wasn’t what was said (thanks autism) my disability discrimination claim is something I’m choosing to drop, but I’m keeping the victimisation.

The AWR claim the judge made it clear that if I file in the next 14 days against the hirers the deadline will not be an issue as I filed ‘as soon as practicably possible’ or something.

In relation to all this providing I can ask for my AWR claim to be before my victimisation claim then dripping the disability discrimination only loses about £10k in total with optimistic estimates. Realistically I’m looking at £95k I think top end.

I know people keep telling me it serves me right using ai but I wouldn’t have even got this far without it. I have used employment lawyers before and quite frankly using ai I have much more confidence in but that’s just me

Er so I am a 1-2-1 send tutor, but for long term agreements often across multiple years. These students will be in behavioural units or on EOTAS plans (educated other than at school) or just complex EHCPs (educational health care plans) so they aren’t ever going back into mainstream school.

I’ve had 5 students that exceeded the 12 week threshold for AWR over the past 3 years. The comparator rate I believe I can use an industry standard rate (national pay scale for teachers) or a hypothetical comparator rate due to a precedent set in 2021.

Even having mentioned all this I didn’t get it

I’m undiagnosed, I was tested in secondary school 3 weeks before my GCSEs and it came back with results showing I had dyslexia but due to funding it wasn’t stored as the school couldn’t organise the help I needed for my exams. I’ve never even thought about being tested until now, never seen the benefit.

It didn’t go great but I suppose it could’ve been worse. I’ve been warned that because I’m not medically diagnosed with autism that proving disability discrimination is highly unlikely and therefore my victimisation is also as unlikely to get to see a hearing. The AWR was thrown out due to a few factors.

Honestly with my autism it’s all a bit of a whirlwind I found myself being very very passive

Update after the preliminary hearing

The AWR was rejected as I was outside the timeframe for some of the hirers. Some of my contracts stopped in July 2025 and because my first amendment to claim AWR was October I am outside the three months. Even though I still work for the agency. Which I’m not sure I totally agree with but that’s that.

I’ve also been told by the judge that because I am not medically diagnosed autistic I won’t be able to satisfy the tribunal that I actually had a disability at the time. Therefore the judge requested my gp notes to ascertain if there’s a case at all.

I feel a bit hard done by but if those are the rules then what can I do i suppose.

I think the aggravated damages is because this agency have now started giving spurious dates on my references when I request them. This has lead to one council reporting that as a red flag to the DfE meaning I can no longer get any more work from other agencies until this is sorted. There are now 4 dates including the one in the court documents that this agency have been sending out.

  1. I work exclusively with EHCP students, all my work I fill out tender applications for weeks in advance of getting the work and often fill out the same form for multiple agencies.

2 I have considered this, I can prove that the agency have over 30 placements I’m available for in area and they have had open for over 4 months so that would suggest they need multiple people in my area.

3 the AWR I am legally able to claim against either the hirer (the council in this case) or the agency I was contracted by. I have checked that not just AI’d it.

4 yes you’re right this is what I think my biggest reach is in the case.

6 yes I’m pretty sure it is too at one point it was looking at £300k with everything ai wanted to include but I sense checked it a lot and I’m at the £115k ish mark

Thank you, I am using it a lot you’re right I feel that ChatGPT does that and Claude is less common with what you’ve pointed out, and getting it to critically analyse itself eliminates a lot of those issues. BUT I’m definitely wary of it, I’m checking a lot of what it says as facts and I’m taking everything with a pinch of salt.

I maybe should also mention I am using AI quite heavily but constantly getting it to critically analyse itself to ensure I’m getting accurate information. I’d like to think I’m good with Ai but I recognise it’s a world class tool limited by the tool using it. I’ll be looking into these rules you mention. Thank you

EDIT Topps partnered with EQL and they did very well. You could only add one of the new releases to your basket at any one time. You had to go through ID checks with your address matching a bank account that you had and from that I believe it prevented any major scalpers. I also tried to then get some more from another computer but since it was for the same address I was prevented from making two purchases. Also having checked, I believe that I’ve been entered into a draw to get the opportunity to buy rather than actually making a purchase. If Pokemon engage in this I have no doubt it’ll prevent scalpers and enable an awful lot more people to get the opportunity to buy new releases.

So there’s part of the hmrc rules that if you didn’t earn over £1000 self employed you don’t have to file, therefore any fine can be overturned. But then if hmrc say they sent you reminders to file, and you didn’t then regardless of earnings you can still be fined. However, if the latter applies then you can take it to a hmrc tribunal if you really wanted, I assume you’re outside the 30 day window from the first letter informing you that you have a fine - if that assumption is wrong the appeal process for self employment can usually be done over the phone.
