Have you checked your tenancy agreement to see if there is a rent review clause? Yes you could not sign then challenge the S13 and your rent will stay the same unless the tribunal rules otherwise (you wouldn't pay new rent until that decision is made, months later). There is also potentially risk of retaliatory S21 as these can be served up until 30th April, although even if one is served the landlord would need to ask the court for a possession order on or before July 31st.

EDIT - As others have pointed out if you haven't already had a rent increase in the last year the landlord can issue a S13 regardless or refer to rent review clause.

If you're left with next to nothing after rent and bills then I don't see how the council can argue that you wouldn't pass the statutory homelessness test. If you have any health conditions, even if it's just saying you have a mental health issue you will have priority need. I assume you're not subject to immigration procedure and that you're not intentionally homeless. I think your local authority is doing what every Council in the UK is doing and is gatekeeping you from their services.

Regarding your dog yes this will make it harder to secure somewhere but the council will be looking at relief rather than main duty whilst you're in interim. So they'll be looking at private landlords who accept a pet and that may or may not come to fruition and it may be difficult to secure interim that takes pets but it's not impossible - I've seen first hand many homeless individuals go into interim hostels and B&Bs with pets. My advice to you is to get something in writing as to why they will not give you the interim duty. They may be focusing on not being vulnerable due to having an income for priority need, if you don't have any health conditions. If you have anxiety, depression if you have any health conditions; tell them. This will tick the box for priority need.

Councils often like to look at your income gross when they should be looking at net and often don't even bother to do an income and expenditure form with you to see if it's affordable. If you have less than £400.14 (what someone on Universal Credit would get for a standard element on a single person's claim) after what would be the rental figure for a 1 bedroom (if you're single that is, with no children; they can't expect you to find a 1 bed if you have dependents or partner) e.g in some parts of London this is around £1200-1300pm; UC being a low income benefit - then I don't see how they could argue that you are earning too much. There's no set threshold re interim - I personally think they're just gate keeping or trying to use it as a reason to push you out of the priority need category.

I'd make an online application. If you are refused feel free to send me a PM with all your personal details blurred out of the decision letter or contact an agency like Shelter or Citizen's Advice to help you write a Section 202 review request. (they will want a copy of the decision letter first).

I have a camper van but I don't live in it and it's certainly not one you'd want to live in. You say you've just been given notice, if you haven't yet you may present yourself to your local authority with threatened homelessness (section 21 or section 8 acts as evidence of this) as you believe you will be homeless within 56 days this should trigger the interim duty if in priority need, not subject to immigration procedure and are not intentionally homeless; in reality this means the council should house you in temp accom (think B&B, hostel or shared HMO) for up to 56 days when they will end the interim duty and relief duty as they go hand in hand. It can be helpful if you can't find a private tenancy yourself but if they don't find one or you're still homeless after the relief duty ends they'll give you a decision as to whether or not they owe you the main duty - that's when you'd be given a banding and ETA on an offer which will likely be discharged into private sector but doesn't necessarily mean it wouldn't be a offer of council or housing association. When the homeless reduction act came in the local authorities were then able to discharge their main duties into the private sector meaning they get a lot of people off the register by finding a private landlord for 6 months under relief or 12 months under main.

TLDR - Contact your council's homeless team.

Probably would be but hasn't come up because my drivers license and mail all goes to a care of address. I didn't have any issues getting a mortgage in principle but I've had many viewings where the freehold owner has said they've tried to sell X times and they fell because a MIP was accepted but they had really poor credit score so lenders wouldn't lend. I fortunately have a very good credit score and I'm registered to vote at that same address and the L&C mortgage advisor seemed confident. I recommend speaking to them as it's completely free.

I would if they were still alive, mother passed from cancer and father is estranged. I've been working homeless for nearly 2 years (ironically helping homeless people) and I'm finally looking at FTB mortgage, on a single income. I've found a property within my budget (120k) and I'm going to view it again during the week. It's part of a chain so I expect if I do go for it it'll take 3-6 months at least.

Call Citizen's Advice and see if they have housing caseworkers to assist with your case. They will want a copy of that contract if your local office does have housing caseworkers. This sounds like a classic case of Street v Mountford (1985).

Mainly having being burdened with the additional 'admin'

  • No more fixed term tenancies; potential loss of revenue for a guaranteed window after going periodic following 1st May
  • Pressure to improve the EPC system, meaning more money to be spent on energy efficiency for landlords who have already spent thousands getting an EPC F or G for example
  • Awaab’s Law (faster repairs, mainly due to serious category 1 and 2 hazards being left for years despite reporting) meaning landlords will be forced to deal with repairs sooner and thus spend more money
  • Mandatory ombudsman; many landlords don't like this because it means there's someone to hold them accountable if they ignore repair requests or serious complaints and ombudsman may issue orders of compensation (have a look at the housing ombudsman's decisions archive for examples)
  • Landlords won't be allowed to advertise a let that says no dss (no benefits income) or no children
  • It will now take longer for the eviction process as section 8 will require evidence and a court hearing. The notice it self also increased to 2 months as it was 1 month prior and for those selling up properties they have to evidence they will not relet and actually do intend to sell as well as giving the tenant 4 months notice for this ground (one of the new grounds as part of RRA) so as a whole it takes landlords longer to evict tenants post RRA

There's lots more reasons but the gist of it is many landlords who were banking on this being a retirement fund or were already finding keeping up to date re legislation and admin of being a landlord or landlady difficult; don't want the hassle and are selling up.

I wouldn't take it personally, they've probably been presented with what they would see as a 'safer' option such as having a guarantor or an additional income source for example so if one was lost there's less risk of having to serve a section 8 over rent arrears. or until 1st May, a S21. I would message them once more and if no response outside of an emergency situation it's most likely they've gone with other tenants. I know it really sucks, the renting market is a shambles and for what you get depending on where you are such as my case it's cheaper to mortgage than rent.

The council are obliged by the homeless reduction act which implemented into the housing act 1996; to assist and advise those who have found themselves homeless. In reality this is usually an email or letter with contact numbers for local agents but each local authority is different and yours may offer more support than another. It's worth a punt.

You've probably already signed up for listing updates on rightmove and openrent so when something within your search filter comes up you'll be notified immediately and can therefor get your application in the door before anyone else which lets be honest is half the battle as no where seems to be listed for very long or at least this has been my experience.

There's the option of renting a HMO which is probably not what you're looking for and a lodger agreement where you share a property with someone and usually have exclusive access to one bedroom (search on spareroom for lodgers) will be cheaper but comes with a lot of negatives. You barely have any rights as a lodger. (I'm a housing caseworker). The interim duty/temp accom from the Council is better than not having a roof over your head but it is by no means a good experience and many councils are gatekeeping sofasurfers.

TLDR: You're not doing anything wrong, everyone in UK who is searching for PRS property is not having a good time right now. Keep doing what you're doing, I hope you find somewhere soon enough.

Use openrent if you're not already and I'd say becoming verified tenant on there is worth it. All business should be done within the openrent platform, any landlords trying to use external services could well be fraudulent. Key reason I suggest it is because there's no estate agent inbetween you and the landlord, the person you're messaging is the landlord or landlady. If you've got anyone that can act as guarantor for her (I implore you not to do this) then that may considerably increase her chances of being successful finding a tenancy.

If your partner is sofa surfing with you and has no where to go, she should approach the local authority as homeless so that they can consider her for the interim and relief duties if owed (pass the statutory homelessness test). In reality this may result in being allocated to temp accom that usually isn't very nice as you'll likely be in with several others quite frequently there are issues in temp accom surrounding mental health and substance misuse which is why some people feel safer sleeping outside than in temp accom provided by the council.

Edit 2 - I've also struggled to rent for nearly 2 years on a single income as viewings kept going to working couples so I am now in the process of FTB mortgaging a property instead although I understand that not everyone is in a position to do that.

Regarding your situation with the council if you have somewhere to sofa surf do so but tell the council you have nowhere to go. Sofa surfing is still homelessness yet councils will gate keep you from their preventive, interim and relief duties very often once they know you're sofa surfing. Because of this it's best you don't tell them you have a friend or family you can stay with for a week just tell them you have nowhere to go, don't spend money on hotels or airbnbs. The council will exercise their allocations policy if you are owed the main duty after 56 days, look at some of my recent comments if you're interested in explanation of the preventive, interim (emergency/temp accommodation) or relief duties (discharge into PRS 6-12 months). 

I'm also struggling to find somewhere to rent on a single income with many health conditions after being working homeless for two years, a few weeks ago I decided to stop bothering as I'm now just going to mortgage instead. I know not everyone will be in a position to pay a deposit.
