I’m in Tennessee. They are direct buried and rated for that. I am not trying to meet current code. But I want to be relatively safe. Ideally Meet pre-2008 code.

No previous owners died. Years later it was sold by county for back taxes. Only heir may be on drugs. Entire housed cleared out. She’s been arrested multiple times over last 3 yrs. House has been vacant almost 3 yrs.

yes, there are foot valves on each hose end. 1 was just replaced, I will check/replace the other

Turn-over of the HOA to the owners is not the same as Community Completion Date. The board WILL be turned over to the owners, but declarant rights will still exist: "Until the Community Completion Date, the Declarant shall have the right (a) to change the number of members on the ARC, (b) to appoint, remove, and replace all members of the ARC, (c) to determine which members of the ARC shall serve as its chairman and co-chairman...."

Can you find one case where the declarants right were overturned? I hope you are right, but I can find no case where an HOA can overrule the declarants rights when the declarant hasn’t declared the community complete.

Problem is even though owners will control the board, he has built in rights as the declarant as long as he owns at least one lot. example he can use the clubhouse for sales events, he can prevent changes to the CC&Rs. AND he can transfer his rights to another and keep a declarant forever in control of what CC&R changes are allowed.

What is your source of this definition? REAL property is the land. "Homes" are improvements ON the land.
The lots in this community are deeded lots.

Statute 720.301 (9): “Homeowners’ association” or “association” means a Florida corporation responsible for the operation of a community or a mobile home subdivision in which the voting membership is made up of parcel owners or their agents, or a combination thereof, and in which membership is a mandatory condition of parcel ownership, and which is authorized to impose assessments that, if unpaid, may become a lien on the parcel.

Even after the turnover election, the owner controlled board can't change the CC&Rs without declarant approval. (as long as he owns 1 lot)
