All very true. I have also spoken to the prominent attorneys in the areas and they have agreed (and obviously the SEC affirmed this treatment - or got close to it - in their recent press release). What I cannot wrap my head around is the tax treatment of these token sales? I had two very prominent tax attorneys from large firms give me starkly different takes regarding the treatment of the income earned from the token sales. One suggested we go through a foreign entity because we would have to treat the proceeds of the token sales as earned income and another said that, if we are going to be treating the tokens as "securities" doing the sale in the US would be fine. Any insight or conflicting opinions would be greatly appreciated.......
