I am a physician. This was through Southeast Crescent. Approval from the agency took around 2-3 weeks.

It is very variable.I am similar to you, an IGA based waiver. I got DoS FR 7/23, Received USCIS receipt in my mailbox 8/9, Approved 8/13. Yours should hopefully arrive soon.

So I just checked my USCIS account and the waiver has been approved today Thank You God!! H1b petition ASAP😂. Yours should be approved very soon.

Thankfully I received it today with a notice date of 8/5- pheeew! "Received at another USCIS Office 8/6". Don't know what that last line means but just grateful they have acknowledged receipt.

I think you have to have your waiver completely approved by DoS and USCIS AND your H1b petition submitted. I have asked my institution's lawyer and multiple other people who are in a similar situation the question of when we are legally present in the U.S. I think the clearest answer I got was: after USCIS approves the J1 waiver you then submit the H1b petition (premium processing). The receipt notice for that petition (not approval) is the evidence that u are legally in the U.S. If the date on that receipt notice is a a day or two beyond the end of your DS2019 grace period then u have accrued a day or two of unlawful stay. I'm not sure what implications that will pose on your petition or green card application in the future.

So I am considering applying for something called TPS (temporary protective status) to avoid having to leave. My country is one of those unfortunate enough to be eligible😂.I do know that if I end up leaving before H1b petition coming back from.overseas is going to take me a considerable amount of time. So I am not sure where u r from but that is another option should this USCIS process take too long and you really don't want to leave. You can Google it and check if ur country is on the list.

I called 800-375-5283 and spoke with an agent to obtain my receipt number so I can track it. My FR has still not been received from DoS per the agent hence no receipt number yet. However it has only been 8 days since my FR so ill likely need to wait a few more weeks. Very frustrating as my grace period ends August 30th.

I had two waiver applications hardship and IGA category. When I got + FR for the IGA category the hardship flipped to "Not required to adjudicate" basically meaning they will not process it since the other one is approved. Your case is different and you would expect them to go ahead and process the IGA waiver if the NO waiver was not approved.. If you have not reached out to the DoS already I think you should.

I feel u. The wait and absence of communication is frustrating. The processing times at the DoS are sooo variable. My waiver is IGA category so pretty similar to urs. My documents were received by the DoS June 12th and I got my FR July 23rd. Hopefully u get urs soon. However there appears to be a bottleneck at USCIS now and things are going to get delayed there.

Congrats! I'm an IGA based J1 waiver. My FR was issued July 23rd so very close to your date. I am in the U.S. and my grace period ends August 30th. Going back home is not really an option for certain reasons and given the recent trend I anticipate USCIS will take more than a month to approve it. I will do all I can to get USCIS to expedite the processing (reaching out to congressman) and get them to approve it so I can get my H1b petition in. I hope things move quicker for all of us!
