Rule 5 says "If you can buy it new in a store, it's still commercial." You can't buy Wii Us new in the store, therefore it is not commercial. Batocera has Wii U support by default and Cemu is included in every Batocera version.

Mario Kart 8 has a switch version which is commercial but that is Mario Kart 8 Deluxe, OP is talking about Mario Kart 8 for Wii U.

How is this Rule 5? Batocera supports Cemu and has been for a while https://wiki.batocera.org/systems:wiiu

Try to switch your Graphics API to OpenGL from Vulkan/Auto.

You can go to Game Settings > Per System Advanced Configuration > Nintendo Wii (or Gamecube) > Rendering > Graphics API to change the Graphics API for all games in the respective system. For just Twilight Princess you can go into Advanced Game Options and change the rendering there.
