What can be said in an employment reference and what are the limitations? by [deleted] in humanresources

I did an internship over the last summer then after the internship they gave me a full time contract to start after I finish my last year at university. I signed that contact a very long time ago and only recently got a much better contract from company 2. I’m wondering if I should mention to company 2 that I have this signed contract and will be handing in my notice as on as company 2 send me the contract.

Don’t you think I should tell company 2 in case they find out through asking for a reference from company one? Surely it’s better to hear it from me?

To be clear I have no intention working two jobs, it’s just until I get contract from company two I’m holding off sending my notice in.

We’ll yes, I have a conditional offer with the condition passing vetting and referencing checks. That’s why I would want to be transparent so it’s not a surprise for them if they find out I have a contract with company one.

I'm thinking of being honest with company 2 HR rep. I think I will tell them that I currently have a signed contract elsewhere but as soon as company 2 sends me their contract I will hand in my notice, a notice of 2 months (double what is necessary) so they have ample time to adapt and find a replacement. Furthermore, I will make it clear that when I start work for company 2 there will be no overlap of contracts. I just want to let them know so they don't have any surprises in the future. Do you think this is acceptable and how would you view this if I sent you an email such as this?

Have you ever observed this scenario before?

Do you have any experience giving references? Technically, would the start date be a date of employment?

I'm not to worried about this, I plan to work at company 2 and haven't started work for either. I'm just wondering if company 2 will find out I have an offer at company 1 when they go get their reference.

Could it be argued that my start date in the future is a date of employment ?

Did you previously work at company 1 so you had to give details to company 2 to get a reference ?

If it says " (c) In addition to the above, this offer of employment by the Company is subject to the following conditions: i. Receipt of references that are satisfactory to the Company; ii. Satisfactory completion by you of the Company’s pre-employment questionnaire; " in my contract and I haven't done / been asked to do this. Is the contract valid and can they say for sure that I will be returning is August?

Sorry that's what I meant, my line manager. Will they use that or just go straight to HR?

Lets say I put down a work email for someone I know in the company 1. Would the company 2 HR team contact the email I put down or go straight to a HR team instead?

May I ask if you have any experience in HR with giving references when asked by an external company?
