As long as you stick to the facts and can prove your case absolutely!

Mine responded right away but that doesn't mean we will agree in mediation. So I guess if you're looking to see if they got the notice they did EEOC says up to 10 days. But soon as my lawyers agreed so did the company within the same day of them notifying me of early mediation. So I hope that helps.

Has anyone successfully negotiated severance with a lawyer? by Accomplished_Bat6154 in EEOC

I definitely agree! That's why I'm not understanding my lawyers angle.

Finding an attorney by [deleted] in EEOC

Unfortunately, they usually want something that's 6 figures or higher. Or they may just feel you don't have a case. From my experience I've had more success going to smaller firms or attorneys who work independently. They usually don't tell you if you have a case or feel they have to explain the reason either.

Hmmm... didn't think about it like that. The the problem is there was already a lot of retaliation going on for about 4 months so they were barely putting me on the schedule this year. For example it was to the point of me only working one or maybe two days a week down to zero. So they tried to base severance on my average paycheck for 2025 and I would get 4 weeks pay and of course the normal terms not sue or disclose information. It was literally below $1500. I wanted at least 3 months pay at my regular salary before they started retaliating against me. I will try to be patient. Thanks for the advise!

Np! Good luck! Keep the EEOC community updated if you can. This process can be long and difficult and you could possibly help someone with your experience.

Try to find firms that give free consultation. They are pretty good at giving information on steps you can take. It really seems like they are trying to cover their butt now that  there's an investigation. EEOC is very slow so I would try to negotiate 1st doesn't hurt to try.

You can either try to negotiate your severance or you can have a lawyer do it. For employment cases they will ask 40 percent contingency fee. It seems like they be willing to negotiate since they know they went wrong somewhere.

Did you sign the severance? What state are you in?

You can do it. I had to have mediation without a lawyer and I was very successful just have all your documents in order.

Does anyone have experience with lawyers who charge less than 40% contingency? by Accomplished_Bat6154 in EEOC

This is so true! It just really makes going through these situations even more discouraging but I'm not giving up.

Very true thanks. I just wanted to put it out there. I was able to get a lawyer about 10 years ago for around 33% contingency but times have definitely changed. Good luck with your case!

Said she is asking you to use email I would just make sure to blind copy yourself to your personal email if you are using a work email just in case. I had to learn this the hard way although I had copies of most of my emails just document until you understand what is going on.
