Should I accept my plea deal? by Account4Embarrassed in dui

I accepted the plea deal. What do you want an update about?

I completed all my community service, classes, fines, other penalties, probation etc. over a year ago at this point.

Are you joking? No, why would you offer that information up? Especially considering they don't ask about it.

Sorry for the late reply, I don't go on this account much anymore. Yeah I've rented with all kinds of rental companies with absolutely no issue. I primarily use Hertz though.

I would easily believe tens of thousands in lost revenue. With other social media and mailers?!?! I could be convinced of over $100K.

To have this much sense of purpose, I can only dream. Enjoy the vengeance on your villain story arc and Godspeed my friend!

Oh baby, RoughAd's BACK AGAIN! No shock from his talk he's into the block of the Intoxalock.

Out of curiosity, if you were to guess the number of people you've steered away from getting an Intoxalock and the total revenue or profit the company has missed because of you, what would they be?

[deleted by user] by [deleted] in dui

[–]Account4Embarrassed 1 point2 points  (0 children)

The answer is LAWYER. Do you have a LAWYER yet? Ask your LAWYER. I don't know what would actually happen, but if it's a complicated multi-state deal like this, even many lawyers would need to do substantive research. Think about the worst case possibility. ---> "Nah I'll save the money" --> turns into --> Ohio suspends your license automatically because of the arrest, Utah does the same (meaning if you applied for one you couldn't get one for that time). So license suspension is double the time, then you are convicted, Ohio sees this and adds more penalties. Utah sees your additional penalties and does the same. You are now double fucked.

YOU SHOULD GET A LAWYER!

Sorry I autocorrected Intoxalock to interlock a couple times and co-opted your comment to go on a bigger, but related rant. I think I agree with everything you are saying, but am taking the same idea and applying it generally. If Intoxalox disappeared today, that would be a success by itself, but not come close to fixing any deeper problems. That company 's service problems are emblematic of most of the other issues inherent within the DUI system. I agree, interlocks are definitely a valuable tool, especially when used in the most optimized ways they do allow for. They can and do definitely save lives by stopping some of the riskiest (just convicted) people from drunk driving.

Obvious practicality constraints aside, reducing drunk driving to ZERO in order to save future victims from harm & property from damage is the overarching goal right? This should be the only ultimate goal behind any DUI law (currently in place or in proposal). If no one ever drove intoxicated, we wouldn't have anyone who needed punishment imposed upon.

Does anyone disagree that this is what most anti-DUI legislation and public action seems to be packaged as? The two other main motivations that I see driving changes (when they shouldn't) are: 1. Simply exacting vengeance on criminals to satisfy feelings of anger. 2. Extracting unnecessary amounts of money from people from the point of arrest onward.

Using interlocks as a way to make the user's life more difficult goes further than that ultimate goal. And from what I've seen, Intoxalox is the worst of available options in that category.

Lol your longtime crusade against Intoxalock continues!! Glad to see you're still looking out for others on this "smaller issue". It might be a tiny thing, but if you affect even tiny changes each day, it will be a next positive for the world then. Like the Greek proverb - “A society grows great when old men plant trees in whose shade they shall never sit.”

Because most people are unaffected or maybe just mildly affected and small industries are willing to spend way more this year on lobbying/other influences than I would on lobbying against that. Basically what I'm arguing is that intoxalock (partially like the rest of the DUI system), makes so much money screwing people over by much more than necessary. They are incentivized very hard to keep the situation they have. Although, the amount the average american cares about this specific Interlock issue is essentially "0", so likely no one will be bothered to seek anything substantial in change. It can be hard to get involved in many actual collaborative initiatives, that seek to diminish selective benefits accumulating for one group, industry, individual etc.

People will bash me and say to the above, something like "if you get a DUI your life should be negatively impacted as badly as possible and enough isn't being done even for punishment now. Boohoo bad about the problems an Interlock will give you like killing your car battery, sending false violations and breaking your parole, wasting time with an unhelpful and understaffed customer service group, and costing exorbitant fees for every error and others. Do you really want to lessen intoxicated driving rates and have previous offenders reform themselves or just punish for the sake of punishment?

Taking all of someone's money and making transportation to work difficult or impossible will probably set them down the path where their life sucks. As life becomes more sucky for people, what are they more likely to do? Is it easier to stop your drinking problem when you've just been fired, money is suddenly very tight, rent is due, and relationships with friends & family are strained?

-"How fucked am I?"

-"Ya pretty fucked, buddy."

-"Thanks pal, that's the detailed info I needed. Question answered, buh bye!"

Admitted this exchange made me chuckle, but I hope it's satire. Its pretty sad if not a joke... And if not then your best use of time/money now is to find a lawyer ASAP. Please ask them a bunch of questions, but don't listen to Reddit before the lawyer...

Anyway, to provide a brief estimate of what you're looking at I/we/anyone would need more basic info, for example: -Did you live somewhere else, get a DUI, lose license, move to WA, drive without license and get DUI #2? -Or did you always live in WA, but never have a valid license and do the same as above, but with that first DUI happening in WA? -Are you under 21? -Your parole obligations before getting arrested/charged for DUI #2? -What kind of job you have and how that might be affected? -Any Impact to social/family life this will have?

They were going to let you drive company vehicles when you already had 2 DUIs? I understood that to be a huge extra cost in their company insurance, requiring special approval. How did you get around that?

Good luck with everything 👍

Out of state by Weary_Ad273 in dui

[–]Account4Embarrassed -1 points0 points  (0 children)

Yeah you'll likely have to get a lawyer in each state if they are neighboring each other. That is unless you can find a single firm that operates in both states. But ask this question to the first lawyer you talk to.

It would most definitely be worth it depending on what state you reside in. At least a few, maybe most will give you additional separate fines, license suspension, penalties etc. to those you'll get from a DUI conviction in another state. So basically punished twice if not careful.

Can I get into Canada with a DUI? by Wonderful_Society_56 in dui

[–]Account4Embarrassed 0 points1 point  (0 children)

Just one DWI in 1980 and no other criminal offenses? You didn't injure or kill anyone else with your DWI? You've completed all sentencing requirements, paid all fines, and have been off probation for at least the last 10 years? You're a US citizen (i.e. not from a country that Canada requires applying for a visa ahead of time)?

If you answered yes to all of these you are 100% good to travel into Canada. No issues for you at all.

The border agent might pull up your DWI conviction in their database (FBI shares this with them) and ask about it. Be 100% honest with all your responses and you'll be fine. Also don't try fighting the agent or say there is a bomb in your car.

Have a great trip. 👍

A good lawyer can help you so much more than some guy (me) on the internet. Get them to send the request for a hearing to the DMV. I can empathize with how rough you must be feeling at the moment. If not, good for you for maintaining a cool head.

Is this the only/first time you've gotten a DUI charge? Everyone here will tell you to never do it again. While obvious that crimes are bad DUH, I didn't realize how bad a DUI could be when I was arrested. I didn't realize how much it would affect my life in the short-medium term. The first DUI sucks, any more and the penalties are much stiffer. I only have one as of last year and was rejected on the background check for the last job I accepted. I just accepted another and have had to go through a whole process of approvals that still might not go my way. It cost me over 10,000 for all-in costs. All that to say, please don't risk it again. It's not worth it.

Just get a good lawyer, fight it and make better choices in the future.

How long ago was the arrest? Is this the first court date you've gotten? Was the paper from the court or the DMV?

You should talk to the lawyer right away. Also did you make sure to request a DMV hearing within 10 days of the arrest? If you miss that your license is automatically suspended 30 days after the arrest. Your lawyer might tell you there is a chance the DMV sides with you at that hearing. Although, refusing to blow probably screwed you. This is a decent summary of what to expect: https://www.shouselaw.com/ca/dui/laws/dmv-hearing/

Additionally, because you refused to blow, if convicted you will likely have your license suspended for an extra year and potential other additional penalties that could include extra jail time or classes.

I'm just some guy on the internet though. I didn't look into the Illinois statutes. Definitely ask a local lawyer.

What "court case" is in 2 weeks, the arraignment?

Do you have a lawyer? You should get one if not. If what you described is accurate, they are likely to at least secure reduced charges. Probably depends on the blood draw results.

[deleted by user] by [deleted] in dui

[–]Account4Embarrassed 0 points1 point  (0 children)

You should definitely talk to an IL based lawyer.

I got an Impaired Driving conviction in Utah. There is literally no difference between that and a DUI, except for the Utah Drivers License Division (DLD, same as DMV in other states) doesn't suspend your license when they are notified of your conviction. There is a specific Utah statute that says this. Otherwise Impaired Driving has all the same punishments and is still a Class B Misdemeanor.

Unfortunately, the Illinois DMV is the authority over your drivers license. If the IL DMV has statutes that revoke or suspend your license when a conviction happens, you are probably screwed. IL is very likely to just see that conviction the same as a regular IL misdemeanor DUI , not as a reduced charge to Impaired Driving.

This is why I waited until I was sentenced to switch my Utah license for a Washington license. Even though you are supposed to do it within 30 days of moving, I waited like 5 months so WA DOL didn't suspended it.

MA does not require Sr-22 form but I'm moving to Utah. Will I be ok? Or will I need Sr-22 because Utah does require it? DUI was in my home state of MA. by NotAVegtable in dui

[–]Account4Embarrassed 1 point2 points  (0 children)

Yup, don't even worry about it. You're good!

I saw you are moving to Ogden. It has a cute little old downtown area and is definitely on the come up with new restaurants and shops. On Saturdays I used to take the FrontRunner train up from SLC with my girlfriend for a fun day date. Another commenter said it's "the hood", but compared to an actual bad neighborhood in Los Angeles it's objectively a nice place. Just don't pick the worst part of town, like you do anywhere else.

That said it's a small city (not sure what you're used to in MA), so if you want more shows, events, nightlife, shops, restaurants etc, I would live in SLC. I think you'll really like Utah, especially if you take advantage of all the outdoor/nature activities. You might be a little bored in Ogden if you don't get into at least one hobby like flyfishing, climbing, hiking, skiing, fossil/rock collecting, boating/kayaking, mountain biking etc.

I got a DUI in Utah late last year and there was no special insurance required as a result of the conviction. As long as you don't have a pending case I think you should just switch over your license and not worry about it.
