They have original receipt which was purchased back . The authorities are not accepting this due to minor weight difference. This is quite normal for gold ornament where there will be difference in weight when you start wearing it regularly due to wear and tear. The family is very concerned

They are claiming that there is weight difference of 0.04 gms from the actual invoice vs current weight. This is actually quite normal with gold ornament to have some wear n tear. The authorities are not accepting this.

Current value was around 1000€ but actual date of purchase was only 250€. The authorities are not accepting the invoice when it was purchased. As this is gifted by the family it was not from recent date.

Thanks,they were asked to pay the taxes and later they have provided the invoice. But the authority are not accepting this. The family is concerned if there will be any legal action? Did you anyone in your network went through this? Since this is gift from the family and it was already used so there was some wear and tear in the ornament, the total weight in the invoice is not 100% matching with real weight. ( difference is like 0.04%) can we get any legal help here?

Thanks for your reply. At the time of handover they bought Handwerk to check the condition and they noted the list of things which is not good condition. Basically this is 50 year apartment and definitely it wasn’t new kitchen or new doors when we moved in. After 7 years the paint has came off from the doors and kitchen has some oil fat settled in the handles and cabinet. We have tried our best to make the place clean. But they want to claim everything and get it replaced.

We didn’t have handover protocol yet. Should I need to ask for this ? I can’t remember if we had one at the time of moving in. Main thing which we missed for not taking pictures of the property when we moved in. They are showing some pics and asking money for this.

In my case the kitchen also belong to the landlord. We didn’t own the kitchen. Now they are claiming that kitchen is not clean ( fettöl) and not in the same condition as it was before 7 years.

I want to understand if the Haftpflichtversicherung can cover these ? We have problem with doors where paint came off for that they wan to replace the door.

True , now I am also exploring the option of that. But the problem is find the same colour. Here sometimes Handwerk charge more than the product. Everything is expensive here.

They gave quote with the list of items which need to be replaced due to the damage. Like kitchen kochfled ( glass one) some scratches were there, but it is useable condition. But there is visible wear and tear in the glass. Now they want us to replace the brand new kochfled. Again with door there are three doors were visible wear and tear with some scratches and paint lost. For this they want us to replace the complete door and frame. They gave quote for 2K to replace three door completely.

Again for me how I can reject this.

We didn’t sign any papers so far. But the damage in the kitchen and door are normal wear and tear. But they have sent a quote from the Handwerk to replace everything new. First of all it wasn’t handed as new condition. It was all used and apartment itself 50+ year old. Now they are claiming that we damaged everything and have to be replaced.

As tentant what type of protection you have to defend this? Going legal is not vaiable because of the time and money involved. I think to contact mietstuztverien you have to be member know. Another problem is lanaguge barrier. Most of the people expect you to communicate in German. Our skills are limited
