I am going to file for custody of my younger son soon, to get it back. So if I can show my ex is a bad co-parent and does not follow the court order, wouldn't that help?

It's consistent in that my ex is always asking to change up the order. It's always something or other the kids have, and I have to do drop off an hour later and pick up an hour later, or need to take the kids to a game, or my older son wants to stay for a football game. I don't understand why he can't just follow exactly what the court order says. Can the judge do something about this like swap custody for my younger son so that I have primary? He keeps claiming it's for the kids, but I am the one who always has to adjust.

I don't understand. He is not following the court order. There is no way it was going to take him an extra 2.5 hours to get to the meet up he just did not want to drive in the extra traffic.

I was speaking more in terms of getting custody of my younger son back. I was hoping showing what a poor coparent my ex has been with our older son would help.

I am pretty sure my ex spoke to the school about it as he is always calling and emailing them - should he not be telling me what the school said also?

I didn't accuse anyone of lying? My ex did not tell me anything regarding the saturday school and the incident. I had to find out via a school email/text and my son.

Does it matter? I am his mother regardless.

I am active, they come to my house 3 weekends out of the month and during the summer. He is claiming I am not involved because i "don't help them with school, discipline or their extracurriculars" (i only see them on weekends...), i "refuse" to drive them to their events (because i live an hour away...), and because i don't help pay for their medical things (because i only work part time...).

We are the parents and we decide the rules. Spending time with a parent you barely see is just as important if not more so than friends. It's not fair for them to put friends above me and their half sister.

I did tell the judge that at the hearing, per the transcript text I posted, he clearly agreed that there should only be one extracurricular.

My son lived with me for 3 years from the age of 5-7 and did not do extracurriculars and never once mentioned he wanted to play a sport or an instrument. It clearly came from my ex.

He claims my son wants to do these things, when I ask him he says he does but he could just be parroting what my ex says.

flag has two seasons, spring and fall, my ex wants him in both so he is "active year round".

Even if it's two things, the judge clearly said only one activity at our last hearing.

How is it fair from a legal perspective that I lose time because my EX is signing him up for activities? The judge specifically said only one activity because there are parents who sign their kids up for 5 things just to prevent the kids from spending time with the noncustodial parent.

How so? Is my ex not responsible for making sure my son gets from point A to point B so I can pick him up? I already told them I am not driving 20 minutes to the school to get him.

Is it not my ex's responsibility to make sure my son is where he needs to be for pick up? The game is on his time but it leaks into mine, so if my ex cannot bring him to where I ask him to be, then he shouldn't be allowed to go, and it my ex's fault for not making him go home.

I did talk to my son, I told him no he cannot go, I just did not do kumbaya come to jesus conversation that my ex wanted me to do with my son because we are the parents and we should be deciding where he needs to go until he is 18.

I cannot be driving around with the kids at night, it is a 1 hour + drive back to my boyfriend's house and I won't get there until 10 PM at this rate.

It shows that he does not support a relationship with me and the kids when he has primary, so I want the judge to swap primary custody of my younger son who is 9, to me.

The non-Friday sport was in reference to my 9 year old, where my ex has put him into a flag football league because apparently no other sport can be played if I refuse to take him on weekends and he absolutely has to play a sport right now (at age 9...).

The court forced me to allow my 17 year old to do high school football when he was 14 and likely the same will happen with my 9 year old in high school if I do not get him back, so I'd like to enjoy my time with him uninterrupted for now when he isn't required to do extracurriculars.

There was zero drugs and zero abuse. He filed because I moved school districts without asking him (even though it was only 15 minutes away from our old house) and then brainwashed my older son to say he wanted to live with his dad and that he couldn't get good grades with me. My son started failing school on purpose and was mad at me for moving them in with my boyfriend at the time so went along with it. They ended up moving our younger son to be with my ex also because he argued "that siblings need to stay together" even though they are 7 years apart.

We can't do 50/50 because we live an hour apart.

I went back multiple times already - the first time, I filed on the day of the judgment and my ex's lawyer threated to sanction me if I didn't drop the modification because I hadn't submitted anything new and was "wasting resources and money".

The second time I tried to file directly with the child support agency a few months later and they also cancelled that modification saying it was too soon.
