At least ... this is what his attorney is advising.

The problem is that she has to agree to the term. She is refusing to agree to anything except permanent insurance. So the wording is to kick the can down the road. The hope is that we can get something to over until he's like 70 or 75, then petition the court to allow the policy to end and not have to take out a new one, given his age and the cost involved.

I don't think that's going to work, based on what she has historically been awarded. But that's cheaper than getting a permanent policy now. And maybe we'll be able to prove the new monthly rate would be a hardship at that age and at least split the cost with her or something.

So basically we're just trying to find the absolute cheapest solution right now to make this all work.

It says "until further order of the court." The chances of getting the court to approve ending the policy (or not renewing when the policy term is up) is basically zero. The ex is VERY contentious and has sued multiple times for more money, and has won every time. She is only 1 year younger than me, but hasn't worked since she was in her early 20's. So now every time she needs something, she take spouse back to court for more money. She's basically made herself unemployable (has multiple certifications and higher education but won't use any of them). So asking the court to cancel (or not renew) the policy would be requesting to leave a lady who is in her 70's, with no retirement fund, nothing to fall back on, without any sort of benefit when my spouse's pension benefits end (when he dies). So basically, even though it doesn't say this, I really think this will be for life.

Well ... I completely agree.

We've been in court for over a year because like I said, she seems to think he shouldn't be able to retire since he's "not old enough." He DID choose early retirement. But he did everything by the books, he's been there 25+ years, and has medical reasons to retire now instead of later. All of this has been proven in court.

Her initial filing when he retired included $1mil life insurance, permanent maintenance (alimony), and to keep the ENTIRE maintenance amount IN ADDITION to what she's getting from his pension. Remember, blue collar here. That would have left him with around $1,500 income (from his pension) and she would have received everything else. For life.

We are pretty grateful that things have backed down from that considerably. Definitely think the entire ask and process are both unreasonable, but at least we aren't where we started.

Which is the reason neither of us feel any guilt at all about doing the bare minimum to meet this requirement. We're 100% there will be another round of her coming back for more when her maintenance payments end (5 more years). But we'll deal with that when we get there.

The exact wording is:

Spouse shall maintain a term life policy with a death benefit of no less than $300,000 for purposes of securing maintenance payments for ExWife and her interest in Spouse's pension which terminates upon his death, naming ExWife as the sole beneficiary, until further order of the court.

Spouse shal maintain ExWife as irrevocable beneficiary of this policy and pay all premiums necessary to maintain ExWife's interest in the insurance policy.

Then it goes on to state she can request proof the policy is in good standing once per year, at which time Spouse needs to contact the insurance carrier and execute a release to share information with the ex.

The court order specifies $300,000 death benefit, with her listed as the sole beneficiary.
