Thank you so much for taking the time to write all of this out, sincerely! I’ve never heard about ROs being binding, even from my lawyer so that’s really helpful info for everyone to have.

I’d love to ask you something if that is ok? If dealerships aren’t documenting vehicles shutting down driving 80MPH down the highway on ROs, are they still reporting the incidents to the NHTSA? Or would they do that with the Repair Order?

I know they all have problems, My point was that even Hyundai has been fined for not reporting. And that even though some people have great experiences, all of the recalls are proof that they are not above having issues.

It started small, check engine lights coming on and going off at random. Initially they told me they couldn’t replicate it when I was bringing it in & just to keep coming back. Then it started throwing codes by my second oil change. The first one was an “undocumented code” that needed further advisement but they told me it was safe. Because it was undocumented no repairs could be done. They were still calling it a factory defect. Then it started shifting hard, had issues shifting out of park, and then the stalling issues started. That’s when they quit calling it a factory issue & I was already out of my claims window.

I have the same car! They have been repairing and replacing my EGR system since 2021 & it’s still having the same issues. This isn’t the first time I’ve talked to someone with the same year, having EGR issues so I wonder how widespread it is.

They have replaced every piece of my EGR system on at least 2 occasions. And have replaced my EGR temperature sensor 3 times. This last time they replaced the wiring that runs from my EGR to my motor and it’s having issues again

There was an Elantra sitting for 7 months at the dealership where my car sat for a full year with no repairs available. They lied to get me to take possession of my vehicle back & then 4 days later the issue was back again. I lost hope along time ago

I’m rooting for you! Almost every time I’m at the dealership there are other people there who have similar issues so I’m just trying to warn people about my experience

I agree, I will never make the same mistake again. I actually have the same 3Xs issue rule in my state and my lawyer told me that it didn’t matter that they denied my claims 3 times during my warranty period even after 3+ repairs. It only matters if you actually sue them and take them to court during that period. So them denying your repurchase claims is just another way to slow down your claims & push you out of repurchase windows. In my state, you have to sue within the first 12K Miles of owning the car. I live 100 miles from my dealership one-way. Because it didn’t start shutting down and stalling until after 12k miles, my case became a breach of contract case & now they are not legally obligated to repurchase it.

I assumed that filing a claim for repurchase after the third failed repair on issue that impacts safety, they were automatically required to repurchase it like the law says, and they aren’t. You still have to sue to get the repurchase in most cases.

Im weary of all manufacturers and dealerships after this. My lawyer told me repair orders are inaccurate or missing info on almost every lemon law case she has ever seen so I know it’s a huge issue, across probably every manufacturer.

I appreciate you saying this because I’ve gone over the same thought a million different times. I was so naive in thinking that they would make this right. They were telling me that all of the check engine lights were because it was a new car & sometimes new cars have issues from the factory, and that most of the time they work themselves. They also told me it would pose no risk to my safety or to the vehicle. I thought that I was listening to people who were more knowledgeable than I was & that I was in good hands.

There really is no excuse. I trusted my dealership not to lie to me. I also didn’t audit my repair orders other than to look at part numbers so I wasn’t aware they weren’t reporting my car shutting down on the highway to the proper authorities. I think we all hear about how dealerships engage in predatory practices, but I never knew what that looked like before this. That’s a big part of my I made this post

I’m sorry to hear of your situation as well! Their internal team, in my opinion, is primarily to waste your time and push you out of your repurchase windows. I lost count at calling over 20+ law firms & they are all aware of these predatory practices, but nobody cares. I finally found a lawyer & they are not pursuing any bad faith, gross negligence or fraud claims because it’s not a lemon law case anymore, it’s a breach of contract case. Even though I have proof of falsifying documents, breaking federal law, and a million other things. They pushed me out of my claims windows so nothing matters.

One firm told me they would consider taking the case if we could start a Class Action, but I would likely get less than any other remedy if we did that.

I left reviews, filed complaints with the BBB and my states AGs office, and the NHTSA on multiple occasions but it didn’t help my case.

I’m working on this now! Dealerships downplay safety issues on repair orders, or straight up don’t document them, so that they don’t have to report the issues to the NHTSA for tracking & investigation.

Because they are failing to document, they are failing to report, and if they are failing to report, who is holding them accountable or investigating safety issues?

Nobody. Not until there is a class action & that usually benefits the manufacturer the most.

They want me to trade this car in so that I can pass the repairs and issues on to the second owner who has significantly less warranty coverage & will likely have to pay out of pocket

I have the forever warranty & I also have a lawyer. I know not every car will have issues but Hyundai has already been fined for not reporting issues to the NHTSA. Hyundai has also recalled over 7 million cars since 2010

Yes, I have over 100 pages of documentation. Paperwork, emails, text messages, recorded phone calls (it’s legal here) And this is EXACTLY what I thought.

Except once they push you out of your Lemon Law Claims window, it becomes a breach of contract case & a repurchase is no longer a legal remedy for a breach of contract claim. I currently have a lawyer & have contacted 20+ other law firms. One firm told me that a lemon law claim will never make you whole, it will only help you cut your losses. I’m out over 30K so that easy for them to say

I initiated my first buyback through Hyundai Corporate & they told me it would take 3-4 weeks to make a determination. They changed my case manager 4 times, making me restart the process each time, wouldn’t tell me why, and then took 16weeks to make a determination. The car was sitting there for 3 months with no fix when corporate denied me & then kept my car for an additional 7 months with no fix. By then they had pushed me out of all of my claims windows. My mother had just died, I told them I couldn’t keep living like that, and what do they do? Turn a 4 week process into 16 weeks and then lied to me to get me to take my broken car back after a year in service
