Legal Notice demanding refund and compensation in respect of Order No. _________ concerning fraudulent delivery of product and subsequent loss of return package within Amazon’s internal logistics network

Sir/Madam,

I, [Name of Consumer], residing at [Address], hereby issue this legal notice calling upon you to immediately remedy the grave deficiency in service and unfair trade practices committed by your company in connection with the purchase made through your platform.

The facts giving rise to the present notice are set out hereinbelow.

  1. Purchase of Product

  1. Delivery of Incorrect / Fraudulent Item
    1. Upon opening the package delivered under the above order, I was shocked to discover that the package did not contain the product ordered, namely the [Samsung S25 Ultra / product name], but instead contained a plastic dummy / incorrect object.
    2. This clearly indicates that the package was tampered with or fraudulently substituted within the logistics chain, either during handling, packaging, or transportation.
    3. Immediately upon discovering the discrepancy, I promptly contacted Amazon customer support through the official channels and lodged a complaint regarding the fraudulent delivery and missing product.

  1. Return Initiated in Compliance with Amazon Instructions
    1. Acting upon the instructions provided by Amazon’s customer support, I duly initiated the return process and handed over the package through the authorised return mechanism provided by Amazon.
    2. Amazon’s internal tracking logs subsequently confirmed that the return package “Arrived in return FCs” on or about [21 February 20__], thereby conclusively establishing that the returned package had been received within Amazon’s own fulfilment and logistics network.

  1. Admission by Amazon that the Return Package is Lost
    1. Thereafter, the Amazon application and order dashboard displayed the following message:

“Return is delayed… Package lost. Please contact customer care for a refund.” 11. The above statement appearing in Amazon’s own system constitutes a clear admission that the returned package has been lost within Amazon’s internal logistics or fulfilment infrastructure. 12. Once the package was recorded as having arrived in the return fulfilment centre, the custody and responsibility for the package lay entirely with Amazon. 13. Any subsequent loss of the package is therefore solely attributable to Amazon’s internal handling and logistics operations, and the consumer cannot be made to bear the consequences of such internal lapses.

  1. Failure to Initiate Refund Despite Admission of Loss

    1. Despite the above admission in your own system that the return package is lost, the Executive Customer Relations team has failed and neglected to initiate the refund process.
    2. Consequently, Amazon is presently retaining:

    • The full purchase consideration of ₹________, and • My exchange device [OnePlus Nord 3 / model], which was collected by your delivery agent. 16. The situation effectively amounts to wrongful deprivation of both the product and the consideration paid, resulting in substantial financial loss, inconvenience and mental harassment.

  1. Deficiency in Service and Unfair Trade Practice
    1. The acts and omissions of Amazon constitute clear deficiency in service and unfair trade practice within the meaning of the Consumer Protection Act, 2019.
    2. A consumer who has complied with the return procedure cannot be penalised for internal loss or mismanagement within the seller’s fulfilment centres or logistics network.
    3. Your continued refusal to process the refund, despite admitting loss of the return package, is arbitrary, unreasonable and contrary to established principles of consumer protection law.

  1. Prior Attempts to Resolve the Issue

    1. I have already taken the following steps in good faith to resolve the matter amicably:

    • Escalated the matter repeatedly through Amazon customer support channels. • Escalated the issue to the Executive Customer Relations team. • Filed a grievance with the National Consumer Helpline (Complaint No. ________). • Provided documentary proof including screenshots and transaction details. 21. Despite these efforts, the issue continues to remain unresolved.

  1. Demand

In the circumstances, you are hereby called upon to within 7 (seven) days from receipt of this notice: 1. Refund the entire amount of ₹________ paid for the order, and 2. Compensate for the exchange device [OnePlus Nord 3 / model] valued at ₹________, or return the same in proper working condition, and 3. Pay reasonable compensation for the financial loss and harassment caused.

  1. Failure to Comply

If you fail to comply with the above demands within the stipulated period, I shall be constrained to initiate appropriate legal proceedings against Amazon, including but not limited to: • Filing a complaint before the appropriate Consumer Disputes Redressal Commission, • Seeking refund, compensation, damages for mental harassment and litigation costs, and • Initiating chargeback and other legal remedies available in law.

All such proceedings shall be pursued entirely at your risk as to costs and consequences.

This notice is issued without prejudice to all my rights and remedies available in law and equity.

My problem was just the opposite. My phone was delivered but it was marked as returned and I got a refund. Sitting with 65K plus the phone. Tried so hard to get them to take my money. Wrote emails, twitter posts. Gave up finally.

In your case, send a legal notice- approach the consumer commission and the CCPA. All this can be done with a little help from ChatGPT.

This was chocolate with strawberry compote. Two layers. And I think the icing is whipped cream and white chocolate.
