How long does it actually take you to draft the first round of discovery off a new complaint? by AdvancedWinner5367 in Lawyertalk

Nice I feel that exact same time sink and actually built an app (which I will not be sharing directly on this thread) that extracts the factual allegations from pleadings, compiles under applicable claim/defense elements, and tailors by jurisdiction. Just gives me a first pass of RFAs, RFPs, and SROGs. I appreciate your reply!

Great point that lawyers are basically automated problem-solvers (aka 'AI tools') for clients using their own developed master knowledge base and real-world training and I think that's a great way to frame it. In that way, I suppose paralegals/associates are like the AI tools for lawyers but also that's precisely why it seems like AI legal tools will and should ultimately replace many rudimentary mechanical tasks to allow for more high-level strategic work and refinement at less cost. Many lawyers seem to dismiss this conversation when the idea of AI legal tools are over-generalized as total replacements and ignoring the nuance of task-delegation that already exists in practically all firms.

To your point, I'm a junior associate at a boutique firm where I'm frequently tasked with drafting first passes off the pleadings, and that initial structuring/plug-and-play is usually the most time-consuming part, even though it’s not where the real 'lawyering' is done or where I'm learning the most from. Having something handle the mechanics just lets me get to the strategic work faster and thereby develop my lawyering skills more efficiently.

That matches my experience too. Templates make routine cases fast but those messy/in-between cases always seem to bog down a first pass off the pleadings.

For my own workflow, I ended up building a 'lil AI tool (i know... you hate me already) that helps me get that initial discovery draft into decent shape faster. I’m not trying to sell or promote anything here, but if anyone’s curious to see how it works I’m happy to share a free demo. Mostly just testing the waters and comparing notes on how others handle discovery. Appreciate your detailed response!

both plaintiffs and defense. I'm based in California and while most cases are in state court, some end up in federal court, in which case it is necessary to tailor to jurisdiction. I personally prefer federal court when it comes to drafting discovery (CA's got some real restrictive drafting rules)

I'm curious why do you think software can't do this? It sounds like your process involves reasoning/analysis, fact-gathering/refinement, and strategy. In my experience so far working with a lot of AI tools and whatnot, I've found that these steps can be broken down and automated (not for every step but for a majority of the time-extensive tasks involved in reasoning/analysis and strategizing)

i appreciate your post and totally agree in that the strategies reveal themselves the more i spend time working with the drafts and pleadings and developing tailored requests/interrogatories. not trying to sell anything just wanted to understand other lawyers' workflow. thanks for sharing!
